Attorney General Kris Kobach argues expansion of ACA violates federal law

TOPEKA — Kansas Attorney General Kris Kobach filed a lawsuit Thursday on behalf of 15 states in an attempt to stop President Joe Biden from expanding health care access to DACA recipients by making them eligible for participation in the Affordable Care Act’s insurance marketplace.

Kobach, a Republican who built a political career concentrated on legal issues tied to undocumented migrants, was&nbsp;<a href="https://ag.ks.gov/docs/default-source/documents/daca-obamacare-complaint-8-8-24.pdf" target="_blank">joined in the federal lawsuit by attorneys general</a>&nbsp;in Alabama, Idaho, Indiana, Iowa, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee and Virginia.

Kobach challenged the federal rule issued by the U.S. Department of Health and Human Services that would make people who arrived in the United States as children, sometimes known as Dreamers, eligible for taxpayer-subsidized health plans under the ACA. The Biden administration’s initiative would enable DACA, or Deferred Action for Childhood Arrivals, to be part of the health insurance marketplace on Nov. 1.

The lawsuit urged the federal court to postpone the effective date of the HHS rule pending completion of the case. It also sought to vacate the rule as “both contrary to law and unreasonable, arbitrary and capricious.”

“Illegal aliens shouldn’t get a free pass into our country,” said Kobach, using an offensive term for undocumented residents. “They shouldn’t receive taxpayer benefits when they arrive, and the Biden-Harris administration shouldn’t get a free pass to violate federal law. That’s why I am leading a multistate lawsuit to stop this illegal regulation from going into effect.”

Kobach said in the U.S. District Court complaint filed in North Dakota that the administration of President Biden and Vice President Kamala Harris intended to violate a federal law forbidding government benefits from flowing to people who weren’t citizens of the United States or were otherwise unlawfully in the country.

He said Congress limited eligibility for federal public benefits to certain “qualified aliens” in 1996. DACA recipients weren’t included in the definition of qualified immigrants, he said. In addition, Kobach’s filing said Congress restricted eligibility to participate in the ACA’s qualified health plans to “citizens or nationals” of the United States or “aliens lawfully present in the United States.”

“Indeed, eligibility for DACA requires unlawful presence in the United States,” Kobach’s petition said.

Xavier Becerra, the secretary of HHS, said when the final DACA rule was published in May the change could lead to 100,000 previously uninsured DACA recipients enrolling in health coverage through the marketplaces.

“HHS is committed to making health coverage accessible for DACA recipients — Dreamers — who have worked hard to live the American dream,” Becerra said. “Dreamers are our neighbors and friends. They are students, teachers, social workers, doctors and nurses. More importantly, they are fellow Americans.”

Kobach asserted the HHS rule would make as many as 200,000 DACA recipients eligible for health insurance through the marketplace. His total of DACA participants included 4,350 in Kansas and 2,550 in Missouri. In terms of other plaintiff states, the numbers ranged from 7,810 in Virginia, 7,450 in Indiana, 6,360 in Tennessee and 4,840 in South Carolina to 220 in New Hampshire, 130 in North Dakota and 80 in Montana.

Alabama Attorney General Steve Marshall said extending health insurance through the ACA to 3,460 DACA recipients in Alabama represented a new “assault on the American worker.”

“First, this administration is demanding that hardworking Americans pay for someone else’s college degree, then it forces them to pay for medical procedures that violate their beliefs, and now they want to dictate paying for health care for people who shouldn’t even be in this country,” Marshall said.

South Carolina Attorney General Alan Wilson said the lawsuit was necessary to derail the Biden administration’s unconstitutional move to broaden the reach of Obamacare.

“I’m sympathetic to these people who didn’t choose to be brought here,” Wilson said. “However, this is yet another example of the Biden administration trying to do something it doesn’t have the authority to do.”

Kan., 14 other state attorneys general file suit challenging health insurance for DACA recipients

WYANDOTTE&nbsp; COUNTY —Law enforcement investigating a Kansas bank robbery have taken a suspect into custody.

The robbery occurred just before 3p.m. Thursday at Mainstreet Credit Union, 8245 State Avenue, Kansas City, KS.&nbsp;

&nbsp;Suspect is described a white or Hispanic male, approximately 6ft tall and 150 pounds.  Suspect was wearing sunglasses, a face covering, a hooded sweatshirt, sweatpants and tennis shoes.

Just before 7p.m. Kansas City, Kansas police reported&nbsp; an individual was been taken into custody without incident within close proximity of the Mainstreet Credit Union. Police thanked partners and residents who assisted officers with their tips.

Suspect captured just hours after Kansas bank robbery

SEDGWICK COUNTY —A funeral for Firefighter Ty Voth, who died battling a fire, was held at 10 a.m. on Friday at Hartman Arena, 8151 N Hartman Arena Drive in Park City.&nbsp;

Before the funeral, there was a public viewing at 9 a.m. at Hartman Arena.&nbsp;

Following the service, Voth was transported to Whitewater Cemetery in Whitewater, Kansas.

Voth was a 2015 graduate of Newton High School and attended Hutchinson Community College, graduating from the Fire Science Program in 2017. He then went on to work at the Manhattan Fire Department until 2019. From there, he was hired on to the Wichita Fire Department, to be closer to his family.

From day one, Ty’s passion was to be a firefighter. He was a second generation firefighter, following in his father's and uncle’s footsteps. In his spare time, he was an avid outdoorsmen, spending most of his time out in the field hunting beside his grandpa, Jack; his brother, Nic; brother-in-law, Matt; cousin, Matthew; his best friends; along with his hunting dog, Mossy.

Ty’s life revolved around his family. He was always there to help when needed and made sure his mother and family were always taken care of. The help and care that he showed extended out to his buddies and their families.

Everyone has their kin family, but Ty was lucky enough to have a second family in Station Five B-Shift. Not only were they firefighters, they enjoyed time together outside of the station, taking vacations and making memories.

He was preceded in death by: his grandmother, Jeannie Belcher; his grandfather, Ray Voth; his uncle, Mike Belcher; his cousin, Ryan Booth; along with his hunting dog, Mossy Girl.

He is survived by: his mother, Angie Voth; his father, Chad Voth; his sister, Riley (Matt); his nephew, Mason; his brother, Nic (Leticia); his sister, Lindsey; his grandpa, Jack; his grandma, Sherry "Bud"; his aunts, Kathy (Tony) and Dana (Kent); his uncle, Kyle; his cousins, Matthew (Deana), Michael (Sydney), and Chad; along with his childhood buddies.

On behalf of the family, they would like to thank the Wichita Fire Department for their support and compassion during this difficult time.

Funeral for fallen Kansas firefighter

JERUSALEM—U.S. Air Force F-22 Raptors arrived in the U.S. Central Command area of responsibility on Thursday as part of U.S. force posture changes in the region to mitigate the possibility of regional escalation by Iran or its proxies, according to a statement from Central Command.

In addition, U.S. Forces in the Middle East continue to face daily threats.

Since Tuesday, U.S. forces successfully destroyed seven Iranian-backed Houthi anti-ship cruise missiles and one Houthi ground control station in Houthi-controlled areas of Yemen. 

Additionally, on Wednesday and Thursday U.S. forces successfully destroyed four Houthi uncrewed surface vessels in the Red Sea, two&nbsp; drones and one Houthi ground control station.

These weapons presented a clear and imminent threat to U.S. and coalition forces, and merchant vessels in the region. This reckless and dangerous behavior by Iranian-backed Houthis continues to threaten regional stability and security.

SEDGWICK COUNTY —&nbsp; A&nbsp; Kansas woman who hid from police for 17-days after a deadly shooting is scheduled for sentencing Friday afternoon, according to the Sedgwick County District Attorney's office.

In March, a jury found&nbsp;<a href="https://ssc.sedgwickcounty.org/InmateSearch/Details.aspx?Id=740335">La’Niha Banks, 19,</a>&nbsp; guilty of murder&nbsp; in the first degree in the commission of a felony and Criminal discharge of a firearm.

Just after 11 pm May 20, 2023 police were dispatched to a shooting in the 1000 block of E 1st Street N. in Wichita's Old Town. Upon arrival, officers located&nbsp; 19-year-old Lationna Johnson &nbsp;with two gunshot wounds to her upper body.

EMS transported Johnson to an area hospital in critical condition and with life-threatening injuries. She died on May 23, accord to Officer Juan Rebolledo.

The investigation revealed that Johnson was trying to break up a physical altercation between an acquaintance of hers and Banks in a parking lot. After the victim managed to stop the fight, Johnson started to drive away, but Banks produced a handgun and started to shoot into the occupied vehicle.

Banks hid from police who finally arrested her on&nbsp;On June 6.&nbsp; She quickly was able to meet the requirements of a $500,000 bond and was out of custody. After the jury verdict, Banks is in <a href="https://ssc.sedgwickcounty.org/InmateSearch/Details.aspx?Id=740335">custody on a&nbsp;$1,000,000.00</a> bond.

Sentencing day: Kan. woman hid from police 17 days after a murder

JOHNSON COUNTY— Two people were injured in an accident Thursday in Johnson County.

Just after 5:00 p.m. near Maurer Road and Shawnee Mission Parkway, the Shawnee Police Department responded to a crash involving pedestrians, according to a media release.

One woman was transported to a local hospital with critical injuries.



According to an initial investigation, following a minor two-vehicle non-injury crash, both drivers exited their vehicles.

As one driver tried to move one of the vehicles involved in the crash, he ran over the other driver, then fell out of the vehicle he was trying to move and was run over by the same vehicle.



Maurer Road over Shawnee Mission Parkway was closed until the investigation was completed. The crash remains under investigation by the Traffic Safety Unit. The Shawnee Fire Department and Johnson County MED-ACT also responded to the crash.

2 injured when run over by a car after Kansas crash

KANSAS CITY —A victim is recovering after fall into the river in Kansas City.

Just before 8p.m. Thursday, the Kansas City Fire Department responded to a reported water rescue in the Blue River, the 39.8-mile-long stream that flows through Johnson County, Kansas, and Jackson County, Missouri.

The victim fell approximately 20-25 feet from an old railroad bridge West of 435 near Hawthorne access road, according to Battalion Chief Michael Hopkins.

The Kansas City Fire Department deployed the Rescue division. Multiple units went to the Hawthorn location along with the Drone. 

One rescue deployed boats from the River Front Park ramp and made their way to the mouth of the Blue River. The victim was located and removed from the river 36-minutes after the call, was transported to the boat ramp and then to a local hospital for treatment of possible fractures but was alert and oriented and stable, according to Hopkins.

 </figure>KANSAS CITY —A victim is recovering after fall into the river in Kansas City.Just before 8p.m. Thursday, the Kansas City Fire Department responded to a reported water rescue in the Blue River, the 39.8-mile-long stream that flows through Johnson County, Kansas, and Jackson County, Missouri.The victim fell approximately 20-25 feet from an old railroad bridge West of 435 near Hawthorne access road, according to Battalion Chief Michael Hopkins.The Kansas City Fire Department deployed the Rescue division. Multiple units went to the Hawthorn location along with the Drone. One rescue deployed boats from the River Front Park ramp and made their way to the mouth of the Blue River. The victim was located and removed from the river 36-minutes after the call, was transported to the boat ramp and then to a local hospital for treatment of possible fractures but was alert and oriented and stable, according to Hopkins..

Samsung recalls electric ranges after numerous fire and injury reports

BARTON COUNTY—Law enforcement are investigating a Kansas woman on multiple allegations after a high-speed chase.

Just after 11:30p.m. Aug. 6, an Ellinwood Police Department officer conducted a traffic stop on a white SUV in the 100 block of East Santa Fe Boulevard, according to Sheriff Brian Bellendir.

 The driver, later identified as 30-year-old&nbsp;Amanda Marie Enrriquez of Great Bend, stopped briefly then fled from the officer. After driving down several streets in the City of Ellinwood, Enrriquez continued west on Highway 56 toward the City of Great Bend.

The pursuit continued through Great Bend then continued west on 56 Highway. During the pursuit, Enrriquez reached speeds in excess of 115 miles per hour, avoided stop sticks, turned its headlights off and on, and at one point traveled head on with a semi that was able to avoid the collision.

Near the town of Pawnee Rock, the Ellinwood officer, Barton County Sheriff Brian Bellendir and several deputies with the Sheriff’s Office were able to use a rolling roadblock to bring the vehicle safely to a stop.&nbsp;Enrriquez was removed from the vehicle and taken into custody. Methamphetamine and paraphernalia were later located in the vehicle.

Deputies transported Enrriquez to the Barton County Jail where she was booked in on requested charges of felony flee and elude, possession of methamphetamine / paraphernalia and driving while suspended.

Kansas woman led deputies on 115mph chase 

JOHNSON COUNTY —A Kansas teen is guilty in a gun sale robbery that left another teen dead.

On August 2, a jury convicted 19-year-old Deon Eugene Austin guilty of first degree murder, aggravated battery; great bodily harm in the death of 16-year-old Jammal Blacknoll, Jr. who died of gunshot wounds, according to the Johnson County District Attorney's office.

Just before 9p.m. April 10, 2022, the&nbsp;Mission, Kansas, Police Department&nbsp;was called to a shooting in the parking lot of an apartment complex In the 5100 block of Foxridge Drive, according to court records.

First responders found Jammaal Blacknoll, Jr. had suffered multiple gunshot wounds and was pronounced deceased at the scene. Austin also suffered a gunshot wound to the left leg. He was transported to to&nbsp;<a href="https://www.childrensmercy.org/" target="_blank">Children’s Mercy Hospital&nbsp;</a>for treatment.

Investigators said a baggie that contained marijuana and a handgun were found at the scene of the shooting. A search of Austin and Blacknoll’s phones confirmed the pair had met to purchase firearms. Witness statements confirmed the incident to be a firearms sale gone wrong as Austin attempted to rob Blacknoll.

An autopsy confirmed Blacknoll had been shot 11 times. Austin was 17 at the time of the shooting but was tried as an adult.

Austin is scheduled for sentencing September 26, according to the district attorney's office.

Kansas gun sale robbery left 16-year-old dead

The right-wing Freedom Caucus fared well in Missouri’s GOP primaries Tuesday, grabbing its first statewide nomination and displaying the reach of its message in other races.

State Sen. Denny Hoskins of Warrensburg emerged from an eight-person field to get the Republican nomination for Secretary of State.

Freedom Caucus member state Sen. Bill Eigel finished second to Lt. Gov. Mike Kehoe in the race for the Republican nomination for governor, garnering 32% of the vote and placing ahead of Secretary of State Jay Ashcroft, son of former U.S. Attorney General, U.S. senator and Missouri Gov. John Ashcroft.

State Sen. Rick Brattin, a founding member of the Missouri Freedom Caucus, defeated well-funded primary challenger Dan Houx by a wide margin. And candidates endorsed by the caucus won the GOP nomination in four of the five state Senate races they contested.

With crowded primary fields for a number of the statewide seats, the caucus members were able to garner 25% to 30% of the vote, enough to boost Hoskins to victory and bring Eigel within striking distance of the winner. In Missouri in recent years, winning the Republican nomination for statewide office has been the key to general election triumph.

Hard-right conservatives have been a thorny issue for Senate Republican leaders for several years. What was considered to be a gentleman’s agreement to work together in the 2021 legislative session failed to appease the conservatives, who eventually announced they were joining the Freedom Caucus for the 2024 legislative session.

The Freedom Caucus is a national organization, with members in Congress and in state legislatures across the country. The mission of the Freedom Caucus is posted on its website: “We need patriots who will serve in our state capitals to fight federal overreach and stand firm against those — in both parties — who prioritize seizing political power over representing constituents.”

In the Missouri Senate this year, the five members of the Freedom Caucus frequently separated themselves from the other 19 Republicans over legislative priorities, creating a dynamic that led to record-breaking filibusters but not major policy wins.

For example, the Freedom Caucus members refused to approve a historically large state budget. That empowered Democrats beyond their 10-seat Senate membership as Republican leaders needed their votes to pass the budget.

Nonetheless, the primary results show that the Freedom Caucus vision remains powerful among many Missouri conservative voters, even with establishment Republican headwinds.

It’s unclear how many will be in the Senate Freedom Caucus when the legislature convenes in January, but if every candidate they endorsed joined, their caucus would have five members. Jim Lembke, a former state senator who works closely with the caucus, said they will be targeting more senators to expand their presence.

“We certainly have to deal with the idea that the status quo still firmly has a grasp, with Mike Kehoe potentially being the next governor,” Lembke said. “There’s still a fight to be fought, but I think we did make great strides.”

The election cycle furthered strained an already battered relationship between the Freedom Caucus and Senate leadership. A PAC connected to incoming President Pro Tem Sen. Cindy O’Laughlin of Shelbina spent $100,000 on ads&nbsp;<a href="https://missouriindependent.com/briefs/missouri-senate-feud-spills-into-governors-race-as-gop-leaders-pac-funds-attacks-on-bill-eigel" target="_blank">targeting</a>&nbsp;Eigel.

Lembke said O’Laughlin and state Sen. Jason Bean, who’s running to be the next majority floor leader, worked to keep Freedom Caucus candidates from being elected.

A PAC that supports Bean gave $15,000 to Susan Haralson, a primary challenger to Freedom Caucus endorsed state Sen. Mike Moon, who ended up winning. Moon has not joined the caucus but frequently participates in their filibusters.

“I don’t think that (leadership’s work against Freedom Caucus candidates) will be forgotten, so there’s going to have to be, an olive branch, put out to the conservatives if leadership wants to accomplish conservative things,” Lembke said.

Neither O’Laughlin or Bean could be reached for comment.

It’s not just Senate leadership that has shown discontent with the Freedom Caucus. State Sen. Jill Carter, a Republican from Granby, announced that she was leaving the caucus earlier this year after a 41-hour filibuster yielded no results.

“Over the past few months, it has become increasingly clear that the values and priorities that some current members of the Missouri State Freedom Caucus profess to champion are not reflected in conversations, behaviors or their strategy,” Carter said on her reasoning for leaving the group in a May post on the social media platform X.

State Sen. Doug Beck, a Democrat from Afton, said he would never “go after colleagues” as O’Laughlin and Bean did in supporting primary challengers. He added that Democrats don’t even advocate for conservative colleagues to be ousted in a primary.

Beck said he thinks the Republican Party has been moving far to the right and that the Freedom Caucus isn’t ideologically far from establishment conservatives. He thinks the Freedom Caucus will cause another session of inaction next spring where Democrats have to provide the deciding votes on key bills like the budget.

KANSAS CITY— A death investigation is underway after Kansas City Police reported on Thursday the body of a missing man had been found in a wooded area, according to Kansas City Police.

Terry Day, 65,&nbsp; was last seen just after 7p.m. August 1, walking with his mixed breed dog in the area of E. 94th Street and Pleasant Avenue in southeast Kansas City, Missouri, according to KCPD.

Law enforcement are investigating the circumstances surrounding the death. The medical examiner will determine the cause and manner of his death.

Body of missing man found in wooded area of Kansas City

Kansas Gas Service agreed to impose a smaller rate hike on customers, increasing bills by an average of $3.83 per month, state regulators announced Thursday.

The deal, which the company and state regulators struck last week, needs approval by the Kansas Corporation Commission. The state agency announced Thursday it would hold a hearing on the proposal next week.

<a href="https://kansasreflector.com/tag/kansas-gas-service/">Kansas Gas Service</a>, which serves almost 650,000 residential customers, filed its periodic request with the KCC to increase rates this spring. The KCC, which regulates monopoly utilities, has been hearing testimony from the company, regulatory staff and consumer advocates.

The&nbsp;<a href="https://kansasreflector.com/2024/06/14/theres-too-much-profit-customers-decry-proposed-natural-gas-rate-increase/">company initially asked to create a two-tiered rate system</a>&nbsp;based on how much gas customers used. Customers who used less than 73,000 cubic feet of gas would have seen a 10.41% hike, which would represent an average increase of $6.71 per month. Kansas Gas Service proposed a smaller rate hike of 8.25% on larger customers. The company said that would result in an average $9.48 increase in monthly bills for major users.

KGS’s agreement with regulators would not impose a second rate tier, but rather impose the average $3.83 increase for all customers.

The hikes KGS requested would have brought in $58.1 million annually for the company from customer bills. But KCC staff argued the company could only justify a $31.7 million increase in customers’ rates. The Citizens’ Utility Ratepayer Board, which advocates for residential and small commercial customers, recommended only a $10.7 million rate hike from customers’ bills.

In a statement, KGS spokeswoman Dawn Tripp said the company is “committed to keeping rates as reasonable as possible.”

“This request is necessary to recover the investments made to maintain a safe and reliable pipeline system,” Tripp said. “Thanks to consistent long-term investments, we have a 999% reliability rate, which means our customers can depend on natural gas for their daily needs, even during challenging weather.”&nbsp;

Commissioners will hear testimony on the proposed agreement Tuesday at 10:30 a.m. at the KCC office in Topeka. They can approve, reject or modify the agreement and need to issue an order on natural gas rates by Oct. 25.

Kansas Gas Service proposed a smaller rate hike of 8.25% on larger customers. The company said that would result in an average $9.48 increase in monthly bills for major users.KGS’s agreement with regulators would not impose a second rate tier, but rather impose the average $3.83 increase for all customers.The hikes KGS requested would have brought in $58.1 million annually for the company from customer bills. But KCC staff argued the company could only justify a $31.7 million increase in customers’ rates. The Citizens’ Utility Ratepayer Board, which advocates for residential and small commercial customers, recommended only a $10.7 million rate hike from customers’ bills.In a statement, KGS spokeswoman Dawn Tripp said the company is “committed to keeping rates as reasonable as possible.”“This request is necessary to recover the investments made to maintain a safe and reliable pipeline system,” Tripp said. “Thanks to consistent long-term investments, we have a 999% reliability rate, which means our customers can depend on natural gas for their daily needs, even during challenging weather.”&nbsp;Commissioners will hear testimony on the proposed agreement Tuesday at 10:30 a.m. at the KCC office in Topeka. They can approve, reject or modify the agreement and need to issue an order on natural gas rates by Oct. 25.

Kansas Gas Service agrees to smaller rate hike for customers

SHAWNEE COUNTY — The City of Topeka is assisting 18 residents after the discovery of unsanitary conditions and a carbon monoxide leak at an apartment building on Wednesday afternoon in East Topeka, according to a media release from the city.

Just before 1 p.m. Wednesday, crews from the Topeka Fire Department (TFD) responded to a reported chemical odor at a residential building located at 313 SE Lime Street.&nbsp; Firefighters measured unsafe levels of carbon monoxide and immediately notified the Kansas Gas Service and the Topeka Police Department’s Property Maintenance Unit (PMU).

Two juveniles were transported to a local hospital by medical personnel to be treated for non-life-threatening injuries.

As a result of PMU’s investigation, raw sewage was found and four apartments have been condemned.

The City of Topeka’s Housing Services Division responded and is working with the affected residents to provide relocation assistance.

RENO COUNTY —The cause of a large commercial building fire in Hutchinson is still under investigation, according to a media release from the Hutchinson Fire Department.

During the response, dispatch advised bystanders were reporting large amounts of smoke and fire. from the building at at 2404 E 4th Avenue. Crews were able to see a large glow and smoke plume while leaving the station.

The first arriving crew found heavy fire and initiated defensive fire operations. The assignment was immediately upgraded to request mutual aid from multiple agencies. Firefighters encountered numerous hazards while fighting the fire that included down charged power lines, numerous explosions, and high heat.

Due to the extensive heat, crews were presented with additional building fires to the surrounding structures that required attention to minimize surrounding structure damage.&nbsp;

Fire crews implemented rigorous on scene rehabilitation procedures to ensure all members were staying hydrated, checked their vital signs, and were able to continue fire suppression efforts. Due to the heat and environmental conditions, two firefighters were hospitalized. They have since been released and cleared for duty.&nbsp;

During the fire, Hutchinson Fire was flowing approximately 7,000 gallons of water per minute. The fire required the use of ten Engines and two&nbsp; Ladder Trucks to sustain suppression efforts. The fire took three 3 hours to bring under control, concluded with three hours of investigation by HFD, HPD, Reno County Sherriff, and the State Fire Marshal. The fire continues to be under investigation pending further interviews.

🎥Cause of massive Kansas business fire still a mystery

WICHITA —A federal grand jury in Wichita&nbsp; returned an indictment charging a man with escaping from a federal detention center, according to the United State's Attorney.

According to court documents, Lee Owen Hallford, 42, is charged with one count of escape from custody.

Hallford is accused of unlawfully leaving the custody of the Bureau of Prisons while at the Residential Reentry Center — Correctional Solution Group, LLC in Wichita. He was detained based on a conviction in the U.S. District Court for the Northern District of Oklahoma for assault with a dangerous weapon with intent to do bodily harm in Indian Country.

The U.S. Marshals Service is investigating the case.

Inmate charged with escape from federal detention center in Kansas

Patrick McKenna, director of the Missouri Department of Transportation, on Wednesday said he will leave his post&nbsp;<a href="https://www.columbiatribune.com/story/news/2015/11/06/modot-hires-new-leader-with/21792490007/" target="_blank">after almost nine years</a>&nbsp;on the job.

McKenna announced his decision&nbsp;<a href="https://www.youtube.com/watch?v=azlKJvxxq_w&amp;t=8870s" target="_blank">near the end of a meeting</a>&nbsp;of the Missouri Highways and Transportation Commission in Poplar Bluff. He did not give a date for his departure and did not return messages seeking comment on his decision.

“I’ve never been more confident in the future of MoDOT… and with the leadership of the commission,” McKenna said. “It’s been a blessing for me to be a part of this, and it’s also a good time to recognize when it’s time to move on, and that’s what I’ll be doing.”

McKenna did not say whether he will be retiring or seeking other work. He said he had contacted the commission members individually on Tuesday to let them know his intentions.

“I have some family obligations to attend to, and I feel that the department is in good hands,” he told the commission.

McKenna was the deputy commissioner of the New Hampshire Department of Transportation when he was hired in 2015. He has presided over a massive expansion of the department’s highway construction program, known as the&nbsp;<a href="https://www.modot.org/statewide-transportation-improvement-program-stip" target="_blank">Statewide Transportation Improvement Plan, or STIP</a>. When McKenna arrived in 2015, commission chairman Dustin Boatwright said during Wednesday’s meeting, the program averaged $325 million annually.

The program approved for the 2025 through 2029 fiscal years averages $4.4 billion annually.

The expansion is partially due to a 2021 increase in the state gas tax, which so far has added 10 cents per gallon to the previous levy of 17.4 cents per gallon. A final step next year will make the tax 29.9 cents per gallon on July 1, 2025.

MODOT has also benefited from&nbsp;<a href="https://missouriindependent.com/2021/11/12/billions-headed-to-missouri-transportation-fund-from-gas-tax-hike-infrastructure-bill/">increased federal funding</a>&nbsp;under an infrastructure bill approved by Congress in 2021 and appropriations of general revenue, including $100 million a year for low-volume roads and $3.4 billion in one-time allocations for&nbsp;<a href="https://missouriindependent.com/2024/02/14/first-contract-for-widening-i-70-approved-by-missouri-highways-commission/">widening Interstate 70</a>&nbsp;and&nbsp;<a href="https://missouriindependent.com/2024/06/27/state-budget-loaded-with-earmarks-nears-deadline-for-action-by-missouri-gov-mike-parson/">Interstate 44</a>.

“We have a historic opportunity in front of us with the funding that we have been entrusted with by the General Assembly and the governor, and there’s no doubt in my mind, this team that we have will execute that flawlessly,” Boatwright said.

McKenna has also had friction with the legislature.&nbsp;

In 2021, the Highways and Transportation commission sued the Office of Administration when Commissioner Ken Zellers refused to allow the commission to implement a pay raise plan that carried a price tag of $60 million. The highways commission wanted to stem turnover at MoDOT and attract new employees.

The raises were not included in the department’s legislatively approved appropriations.

That led six state senators — including state Sen. Cindy O’Laughlin of Shelbina, who has since become Senate Majority Leader and is expected to be Senate President Pro Tem next year, — in a February 2022 letter to the commission, to demand that&nbsp;<a href="https://missouriindependent.com/2022/02/03/missouri-transportation-chief-under-fire-for-bucking-lawmakers-on-pay-raise-plan/">McKenna either resign or be fired</a>.

The highways commission filed the lawsuit to test constitutional language that is unique to the road fund. The Missouri Constitution states that the money deposited in the fund shall “<a href="https://revisor.mo.gov/main/OneSection.aspx?section=IV++++30(b)&amp;bid=31847&amp;constit=y" target="_blank">stand appropriated</a>&nbsp;without legislative action.”

Last year, Cole County Circuit Judge Cotton Walker&nbsp;<a href="https://missouriindependent.com/2023/11/01/judge-approves-pay-raise-plan-for-missouri-transportation-agency-workers/">agreed with the commission</a>&nbsp;that it could use money in the road fund at its discretion. The decision is being appealed but no date has been set for oral arguments.

Commissioner Dan Hegeman, a former senator who signed O’Laughlin’s letter, praised McKenna on Wednesday for his professional demeanor in disputes with the General Assembly.

“He’s got a lot to be proud of as he takes on a new challenge that is going to be great for him and his family,” Hegeman said.

There was no discussion of who will take over as director or whether there would be an interim director during a search. McKenna stated there is a plan but gave no details.

“I know the commission has a plan that there will be no gap in leadership,” McKenna said. “I want the whole team to understand that it’s been an absolute blessing to be here.”

‘It’s time to move on’: Missouri transportation director announces resignation

More than once during the campaign, Parson faced allegations that he was illegally using public resources for campaign purposes

Missouri Gov. Mike Parson wasn’t on the ballot Tuesday.&nbsp;

But he was still one of the biggest winners of the night.&nbsp;

Watching from the sidelines as election results poured in — barred from running again because of term limits — Parson’s legacy was before voters in the form of the three men he appointed to statewide office: Lt. Gov. Mike Kehoe, Attorney General Andrew Bailey and Treasurer Vivek Malek.

Each emerged victorious in Tuesday night’s GOP primaries.&nbsp;

In a state that hasn’t elected a Democrat to statewide office since 2018, Kehoe is now the favorite to replace Parson as governor, while Bailey and Malek hope to earn full terms in November.&nbsp;&nbsp;

“How can you not say that tonight was a great affirmation of all the nominations the governor has made?” said Mark Milton, who served as treasurer of Committee for Liberty, the PAC supporting one of Kehoe’s rivals for the gubernatorial nomination, Jay Ashcroft.&nbsp;

Margie Vandeven, the state’s former education commissioner, agreed that Tuesday night was a big win for Parson.&nbsp;

“I’m not surprised,” she said. “He did a great job.”

The governor has made it no secret that the success of his appointees is a big part of the legacy he hopes to leave behind. He touted his impact&nbsp;<a href="https://missouriindependent.com/2024/01/24/missouri-governors-final-state-of-state-touts-abortion-ban-infrastructure-spending/">on state government</a>&nbsp;through his appointees in his final State of the State address to the legislature earlier this year, and has made it clear he’s willing to do whatever he can to ensure their success.&nbsp;&nbsp;

In some ways, Parson’s entire governing philosophy was on the ballot Tuesday, with his appointees facing candidates who decried the culture of Jefferson City as corrupt and pilloried him as a RINO — a “Republican In Name Only.”

“You got to realize you don’t have to agree with everybody on all the issues, but you still got to govern,” Parson posted on&nbsp;<a href="https://x.com/GovParsonMO/status/1820842288341246049" target="_blank">social media</a>&nbsp;Tuesday morning, “and that’s what we come up here to do.”

Parson did more than just endorse his favored candidates. Throughout the campaign, he’s shown a willingness to use his taxpayer-funded office to put his thumb on the scale — earning criticism and allegations that he was&nbsp;<a href="https://missouriindependent.com/2024/01/17/stinks-quite-a-bit-mike-parson-accused-of-illegally-using-office-to-meddle-in-primaries/">illegally using public resources for campaign purposes</a>.

But he largely shrugged off those concerns, and by the campaign’s final week, wasn’t willing to stand by and let the primaries play out.&nbsp;

The PAC that has supported Parson’s political campaigns since 2018 — and bankrolled his trips to the Super Bowl the last two years — started&nbsp;<a href="https://missouriindependent.com/briefs/pro-parson-pac-seeks-to-boost-missouri-governors-favored-candidates-in-gop-primaries/">spending its massive war chest&nbsp;</a>to boost Kehoe and Bailey.&nbsp;

The money came in large chunks from loyal Parson donors — David Steward, whose technology firm&nbsp;<a href="https://missouriindependent.com/2024/08/06/missouri-education-officials-apologize-for-ongoing-backlog-of-child-care-subsidy-payments/">holds contracts with the state</a>; the Missouri Cannabis Trade Association, an industry regulated by the Parson administration; Torch Electronics, a Wildwood-based company accused of operating illegal gambling machines; and MACO Development Co., a beneficiary of low-income housing tax credits.

He also got a $300,000 from the St. Louis law firm of Eric Holland.&nbsp;

He touted his impact&nbsp;<a href="https://missouriindependent.com/2024/01/24/missouri-governors-final-state-of-state-touts-abortion-ban-infrastructure-spending/">on state government</a>&nbsp;through his appointees in his final State of the State address to the legislature earlier this year, and has made it clear he’s willing to do whatever he can to ensure their success.&nbsp;&nbsp;In some ways, Parson’s entire governing philosophy was on the ballot Tuesday, with his appointees facing candidates who decried the culture of Jefferson City as corrupt and pilloried him as a RINO — a “Republican In Name Only.”“You got to realize you don’t have to agree with everybody on all the issues, but you still got to govern,” Parson posted on&nbsp;<a href="https://x.com/GovParsonMO/status/1820842288341246049" target="_blank">social media</a>&nbsp;Tuesday morning, “and that’s what we come up here to do.”Parson did more than just endorse his favored candidates. Throughout the campaign, he’s shown a willingness to use his taxpayer-funded office to put his thumb on the scale — earning criticism and allegations that he was&nbsp;<a href="https://missouriindependent.com/2024/01/17/stinks-quite-a-bit-mike-parson-accused-of-illegally-using-office-to-meddle-in-primaries/">illegally using public resources for campaign purposes</a>.But he largely shrugged off those concerns, and by the campaign’s final week, wasn’t willing to stand by and let the primaries play out.&nbsp;The PAC that has supported Parson’s political campaigns since 2018 — and bankrolled his trips to the Super Bowl the last two years — started&nbsp;<a href="https://missouriindependent.com/briefs/pro-parson-pac-seeks-to-boost-missouri-governors-favored-candidates-in-gop-primaries/">spending its massive war chest&nbsp;</a>to boost Kehoe and Bailey.&nbsp;The money came in large chunks from loyal Parson donors — David Steward, whose technology firm&nbsp;<a href="https://missouriindependent.com/2024/08/06/missouri-education-officials-apologize-for-ongoing-backlog-of-child-care-subsidy-payments/">holds contracts with the state</a>; the Missouri Cannabis Trade Association, an industry regulated by the Parson administration; Torch Electronics, a Wildwood-based company accused of operating illegal gambling machines; and MACO Development Co., a beneficiary of low-income housing tax credits.He also got a $300,000 from the St. Louis law firm of Eric Holland.&nbsp;Kehoe benefited from some of that spending, but the focus was Bailey, who was working to fend off a well-funded Republican challenger, former assistant U.S. attorney and member of Donald Trump’s legal team, Will Scharf.&nbsp;The pro-Parson PAC ran TV ads attacking Scharf. And days before voters headed to the polls, the governor used official letterhead to publicly condemn an ad attacking Bailey and&nbsp;<a href="https://missouriindependent.com/2024/08/01/statewide-officials-scramble-to-grab-attention-in-homestretch-of-missouri-primary-campaign/">convened a press conference in the Capitol&nbsp;</a>with the attorney general to announce a crackdown on unregulated cannabis products.“In this race, we were not just up against the Bailey campaign,” Scharf told supporters Tuesday night during his concession speech. “We were up against the official office of the Attorney General. We were up against Gov. Parson. We were up against the entire Jefferson City establishment.”In an interview last month, Kehoe acknowledged that he’s seen by many as Parson’s stylistic and ideological successor. But he also said there have been plenty of areas where the two have disagreed over the years.&nbsp;“But we don’t air that in public,” he said.&nbsp;His approach to being governor would likely be very different from Parson’s, Kehoe said, but he hopes to live up to the high standard he believes Parson has set.&nbsp;“I consider Mike Parson a friend. I’ve known him for a long time,” Kehoe said. “Mike has taken on some very tough challenges.
