Judge grants preliminary injunction hearing on SJSD reorganization plan

A preliminary injunction hearing in a lawsuit filed by a local group that is trying to halt the St. Joseph School District's reorganization plan has been granted by Circuit Court Judge Kate Schaefer.

Schaefer, the 5th Judicial Circuit Court of Andrew and Buchanan County, will hear We The People - 3 Schools Inc.'s request for a preliminary injunction on Friday, May 29th.  The "We the People- 3 Schools Inc.", a Missouri nonprofit corporation, has filed a lawsuit in Buchanan County Court, against the St. Joseph School District, the Board of Education and every current member of the board.

According to court documents, the 52-page lawsuit alleges that the St. Joseph School District Board of Education's "adoption of Plan 4BR is unconstitutional, unlawful, unreasonable, arbitrary, or capricious or involves an abuse of discretion under Section 536.150, RSMo."

The other count stated in the lawsuit alleges multiple Sunshine Law violations.
