GRAY&nbsp; COUNTY —A Kansas high school principal warned parents of a deadly TikTok challenge.

Principal Leona Engelcke alerted parents of students at&nbsp;Cimarron Junior and Senior High School&nbsp;participating in or possessing videos&nbsp;of the deadly TikTok challenge called “blackout,” “ghosting,” or “the pass out challenge.”

According to her statement on the <a href="https://www.facebook.com/photo/?fbid=617376786855107&amp;set=a.430909895501798">school's Facebook page</a>, "The TikTok challenge encourages people to choke out for a temporary high. The individual chokes themselves or is choked by someone until they lose consciousness."

“There have been fatalities from this challenge, though not here in Cimarron, and we would like to keep it that way,” according to Engelck's statement. "Losing consciousness by being choked out can lead to injury, from minor to even death."

She urged parents to talk with their children and encourage them not to support or participate in the challenge.

SW Kansas high school warns of deadly TikTok challenge

CAPE GIRARDEU, Mo. (AP) — A man has pleaded guilty to&nbsp;<a href="https://apnews.com/article/6784aa5915e56eb6cc451588503bc20e">hate crime and arson charges</a>&nbsp;for setting a fire that destroyed an Islamic center in southeast Missouri two years ago, the U.S. Justice Department announced Tuesday.

Nicholas John Proffitt, 44, entered the plea in the case of the torching of the Cape Girardeau Islamic Center on April 24, 2020, which was the first day of the Islamic holy month of Ramadan, the department said. It was the second time he had attacked the building.

Security video showed Proffitt breaking the building's glass window and throwing two containers inside. He then entered, poured the contents of two gallon-size containers throughout the foyer and the hallway and lit the blaze, according to court records.

About a dozen people were inside at the time but escaped unharmed. The fire made the building unsuitable for use as a center.

Proffitt admitted he set the blaze because of the religious nature of the building, prosecutors said.

His public defender did not immediately return an after-hours phone call seeking comment.

Sentencing is set for May 22. Proffitt faces up to 20 years in prison for damage to religious property and a mandatory minimum of 10 years, consecutive to any other sentence, for using fire to commit a federal felony. He also could be fined up to $250,000 on each charge.

In 2009, Proffitt pleaded guilty to state charges for throwing rocks that damaged the same mosque and a vehicle in the parking lot. He was sentenced to three years in prison in that incident.

MARIES COUNTY —A Missouri teen died in an accident just before 10:30p.m. Tuesday in Maries County.

The Missouri State Highway Patrol reported a 2007 GMC Yukon driven by a 17-year-old Dixon, Missouri, boy was westbound on Highway N two miles west of Highway 28.

The SUV traveled off the road, struck a tree and caught fire. The teen was pronounced dead at the scene and was transported to Birmingham-Martin Funeral Home. He was properly restrained, according to the MSHP.

NEW YORK (AP) — The U.S. government charged Samuel Bankman-Fried, the founder and former CEO of cryptocurrency exchange FTX, with a host of financial crimes on Tuesday, alleging he intentionally deceived customers and investors to enrich himself and others, while playing a central role in the company's multibillion-dollar collapse.

Federal prosecutors say that beginning in 2019 Bankman-Fried devised “a scheme and artifice to defraud” FTX's customers and investors. He illegally diverted their money to cover expenses, debts and risky trades at his crypto hedge fund, Alameda Research, and to make lavish real estate purchases and large political donations, prosecutors said in a 13-page indictment.

Bankman-Fried, 30, was arrested Monday in the Bahamas at the request of the U.S. government, which charged him with eight criminal violations, ranging from wire fraud to money laundering to conspiracy to commit fraud. If convicted of all the charges, Bankman-Fried — referred to by crypto enthusiasts as “SBF” — could face decades in jail.

At a press conference on Tuesday, U.S. Attorney Damian Williams called it “one of the biggest frauds in American history,” and said the investigation is ongoing and fast-moving. He urged anyone who believes they were victims of the alleged scheme to contact his office.

Bankman-Fried has fallen hard and fast from the top of the cryptocurrency industry he helped to evangelize. FTX filed for bankruptcy on Nov. 11, when it ran out of money after the cryptocurrency equivalent of a bank run.

Before the bankruptcy, he was considered by many in Washington and on Wall Street as a wunderkind of digital currencies, someone who could help take them mainstream, in part by working with policymakers to bring more oversight and trust to the industry.

Bankman-Fried had been worth tens of billions of dollars -- at least on paper -- and was able to attract celebrities like Tom Brady or former politicians like Tony Blair and Bill Clinton to his conferences at luxury resorts in the Bahamas.

Sporting shorts and t-shirts to contrast himself with the buttoned-down world of Wall Street, he was the subject of fawning profiles in media, was considered a prominent advocate for a type of charitable giving known as “effective altruism,” and commanded millions of followers on Twitter.

But since FTX’s implosion, Bankman-Fried and his company have been likened to other disgraced financiers and companies, such as Bernie Madoff and Enron.

The criminal indictment against Bankman-Fried and “others” at FTX is on top of civil charges announced Tuesday by the Securities and Exchange Commission and the Commodity Futures Trading Commission. The SEC alleges Bankman-Fried defrauded investors and illegally used their money to buy real estate on behalf of himself and his family.

U.S. authorities said they will try to claw back any of Bankman-Fried’s financial gains from the alleged scheme.

A lawyer for Bankman-Fried, Mark S. Cohen, said Tuesday he is “reviewing the charges with his legal team and considering all of his legal options.”

At a congressional hearing Tuesday that was scheduled before Bankman-Fried's arrest, the new CEO brought in to steer FTX through its bankruptcy proceedings leveled harsh criticism. He said there was scant oversight of customers' money and “very few rules” about how their funds could be used.

John Ray III told members of the House Financial Services Committee that the collapse of FTX, resulting in the loss of more than $7 billion, was the culmination of months, or even years, of bad decisions and poor financial controls.

“This is not something that happened overnight or in a context of a week,” he said.

He added: “This is just plain, old-fashioned embezzlement, taking money from others and using it for your own purposes.”

Before his arrest, Bankman-Fried had been holed up in his luxury compound in the Bahamas. U.S. authorities are expected to request his extradition to the U.S., although the timing of that request is unclear.

At a court hearing in the Bahamas on Tuesday, prosecutors argued that Bankman-Fried was a flight risk and should be held without bail, according to Our News, a broadcast news company based there. His lawyers said he is likely to request a formal extradition hearing.

Bankman-Fried's was previously one of the world’s wealthiest people on paper; at one point his net worth reached $26.5 billion, according to Forbes. He was a&nbsp;<a href="https://apnews.com/article/sam-bankman-fried-ftx-crypto-downfall-a2eaec231027dfd9f18426ff8982bbf8">prominent personality in Washington</a>, donating millions of dollars to Democrats and Republicans. As customers sought to withdraw billions of dollars, FTX could not satisfy the requests: their money was gone.

“We allege that Sam Bankman-Fried built a house of cards on a foundation of deception while telling investors that it was one of the safest buildings in crypto,” said SEC Chair Gary Gensler.

The SEC complaint alleges that Bankman-Fried had raised more than $1.8 billion from investors since May 2019 by promoting FTX as a safe, responsible platform for trading crypto assets.

Instead, the complaint says, Bankman-Fried diverted customers' funds to Alameda Research without telling them.

"He then used Alameda as his personal piggy bank to buy luxury condominiums, support political campaigns, and make private investments, among other uses," the complaint reads.

In the weeks after FTX's collapse, but before his arrest, Bankman-Fried gave interviews to several news organizations in which he grasped for ways to explain what happened.

For example, Bankman-Fried said he did not “knowingly” misuse customers’ funds, and that he believes angry customers will eventually get their money back.

At Tuesday's congressional hearing, the new FTX CEO bluntly disputed those assertions: “We will never get all these assets back,” Ray said.

Jack Sharman, an attorney at Lightfoot, Franklin &amp; White, said Bankman-Fried's recent comments to the media could be damaging, admissible evidence in court. "Those statements in that speaking tour were in no way helpful to his cause,” Sharman said.

In its complaint, the SEC challenged Bankman-Fried's recent statements that FTX and its customers were victims of a sudden market collapse that overwhelmed safeguards that had been in place.

“FTX operated behind a veneer of legitimacy," said Gurbir Grewal, director of the SEC’s enforcement division. "That veneer wasn’t just thin, it was fraudulent.”

The collapse of FTX — which followed other cryptocurrency debacles earlier this year — is adding urgency to efforts to regulate the industry.

Yesha Yadav, a law professor at Vanderbilt University who specializes in financial and securities regulation, said U.S. lawmakers and regulators have been too slow to act, but that is likely to change.

“Lawmakers are clearly under pressure to do something, given that so many people have lost their money,” she said.

WASHINGTON — The Internal Revenue Service today reminded employers 
and self-employed individuals that chose to defer paying part of their 
2020 Social Security tax liability that their second annual installment 
of the deferred amount is due on December 31, 2022.

As part of the COVID relief provided during 2020, employers could 
choose to put off paying the employer's share of their Social Security 
tax liability, which is 6.2% of wages. Self-employed individuals could 
also choose to defer a similar amount of their self-employment tax. 
Generally, half of that deferral was due on December 31, 2021. The other
 half is due on December 31, 2022.

Earlier this fall, the IRS sent reminder notices to affected 
employers and self-employed individuals. The agency noted, however, that
 those affected are still required to make the payment on time, even if 
they did not receive a notice.

Employers and individuals have several options for making this payment. IRS deadline looms for many employers, self-employed people

KANSAS CITY—A jury&nbsp; convicted Dmarius M. Bozeman in the fatal shooting in February 2021 of Khasheme Strother, who was inside a Kansas City residence on W. Pennway with her three children, according to Jackson County Prosecutor Jean Peters Baker.

In September, a Jackson County jury convicted 34-year-old Bozeman of Murder 2nd Degree, Armed Criminal Action, two counts of Endangering the Welfare of a Child 1st Degree, one count of Endangering the Welfare of a Child 2nd Degree and three additional counts of Armed Criminal Action.

The judge on Friday sentenced the defendant to 25 years on Murder 2nd Degree and five years on the other counts. He set the 25-year sentence and the 5-year sentence to run consecutively for a total of 30 years.

According to court records, Kansas City police responded to the 1900 block of W. Pennway Terrace on a reported shooting. Police found two deceased adults and another injured adult. The injured adult stated he had called 911. In the 911 recording he indicates he shot the adult male, Ramond Hill, 19 in self defense and that he also shot Strother after he was jumped. 

Bozeman said Strother was his girlfriend and the other victim was her son. Three juveniles were in the residence at the time of the shooting. Bozeman told police he had been in a struggle with Strother and he fired what he thought were two warning shots. Soon after he saw she had been shot. Bozeman said he fired at Hill after he came back inside the residence and fired shots at him.

The
 former director of Agape Boarding School pleaded with a Cole County 
judge on Monday to keep himself off the state’s central registry of 
child abuse and neglect so he can keep working with children.

Bryan Clemensen was the long-time 
director of the Stockton-based reform school for troubled boys until 
last month, he testified Monday.&nbsp;

The Missouri Department of Social 
Services says it substantiated five preponderance of evidence findings 
against Clemensen — one count of child neglect and four of physical 
abuse.&nbsp;

The department is seeking to add 
Clemensen’s name to the state’s child abuse and neglect central 
registry, a database listing the names of those the state has <a target="_blank" href="https://revisor.mo.gov/main/OneSection.aspx?section=210.110#:~:text=(1)%20%22Abuse%22%2C,be%20construed%20to%20be%20abuse.">concluded</a> perpetrated child abuse or neglect. Those listed in the central database are <a target="_blank" href="https://www.law.cornell.edu/regulations/missouri/13-CSR-35-71-015">forbidden</a> from working in residential care facilities such as Agape and are subject to other limitations working around children.

Employers at <a target="_blank" href="https://revisor.mo.gov/main/OneSection.aspx?section=210.150">facilities which provide services or care to children</a> can request to access the registry’s information.

Clemensen is asking the court for a preliminary injunction to remain off the central registry.&nbsp;

“If I’m on the central registry in 
the state of Missouri, I’d effectively no longer be able to work at 
Agape,” Clemensen testified Monday in Cole County, adding that after 
spending decades working with troubled teens, he would have to seek a 
“career change.”&nbsp;

Clemensen was notified of the state’s
 findings in May. He appealed the decision, and the Child Abuse and 
Neglect Review Board independently reviewed the case last month and 
upheld the social service department’s findings.&nbsp;

At that point, Clemensen’s attorney 
in this case, Jason Call, filed a motion for a restraining order to 
temporarily prevent the state from placing him on the registry — which 
Cole County Circuit Judge Brian Stumpe granted late last month.&nbsp;

Clemensen’s motion argued that being 
placed on the registry directly affects his “reputation and ability to 
obtain employment,” as well as the “continued operation of Agape…which 
relies upon [Clemensen] and other employees for its continued 
operation.”&nbsp;

The judge ruled that allowing the 
Department of Social Services to list Clemensen on the registry while 
his appeal is pending could “result in significant damage to 
Petitioner’s reputation and will directly interfere with Petitioner’s 
employment.”

The judge will issue a decision on the preliminary injunction Dec. 21, as the temporary restraining order expires Dec. 22.&nbsp;

The hearing Monday did not detail the
 specific allegations against Clemensen. According to the attorneys’ 
characterizations, the abuse findings deal with allegations of 
Clemensen’s use of physical restraints, and the neglect finding involves
 allegations that Clemensen withheld food.&nbsp;

Clemensen denies the allegations and seeks a full hearing on their merits.&nbsp;

He served as director of Agape from 
1990 to 2008, and 2018 to November of this year. He is now a property 
manager in Stockton, he testified Monday, for Agape Land Management and 
Clemensen Family Land.

Asked if he can survive on income 
from property management, Clemensen said “absolutely not,” and that he 
is looking at local job boards for other employment, but knows if he is 
“put on the list, I’m going to have to have a career change.”&nbsp;

As his attorney summarized it, “at 57 years of age, you’d be looking for a new career.”&nbsp;

Clemensen’s testimony is the latest 
in a string of court developments surrounding the embattled boarding 
school, which has faced mounting allegations of abuse from former 
students and was at the center of a Kansas City Star investigation of 
unlicensed boarding schools in 2020.&nbsp;

Agape currently faces over 20 <a target="_blank" href="https://missouriindependent.com/2022/08/22/lawsuits-mounting-against-unlicensed-missouri-boarding-schools-accused-of-abuse/">lawsuits</a>, which include allegations from former students that they were physically <a target="_blank" href="https://missouriindependent.com/2022/07/21/candidates-ties-to-missouri-reform-schools-facing-abuse-allegations-draw-fresh-scrutiny/">restrained</a>
 and starved as a form of punishment, forced to submit to physical labor
 and taken off prescribed medications and reassured that “God would fix 
them.” <a target="_blank" href="https://missouriindependent.com/2022/09/21/missouri-judge-once-again-delays-decision-on-closing-agape-boarding-school/">Other court filings detail allegations</a>
 including that students experienced “severe bruising” after being 
restrained, were slammed into the ground and pushed into walls, and kept
 in handcuffs for days at a time.&nbsp;

Last year, the Cedar County prosecuting attorney Ty Gaither filed <a target="_blank" href="https://missouriindependent.com/briefs/prosecutor-files-felony-charges-against-five-agape-staffers-accused-of-abuse/">only a fraction of the counts </a>against
 Agape that Missouri Attorney General Eric Schmitt recommended. Of the 
five staff members charged by Gaither, two of them last week <a target="_blank" href="https://www.kansascity.com/news/local/crime/article269739346.html">pleaded guilty last week to lesser misdemeanors </a>and the case was dropped against a third.&nbsp;

Although the attorney general and social services department filed litigation to shutter Agape in <a target="_blank" href="https://missouriindependent.com/2022/09/08/court-order-would-close-agape-boarding-school-after-years-of-abuse-allegations/">September</a>,
 alleging a systemic pattern of abuse at the school which raises health 
and safety concerns to current students, the case has been <a target="_blank" href="https://missouriindependent.com/2022/09/21/missouri-judge-once-again-delays-decision-on-closing-agape-boarding-school/">tied up</a> in court and the school remains open.&nbsp;

Clemensen’s case against the 
Department of Social Services is distinct from the state’s case against 
Agape Boarding School — both are ongoing.&nbsp;

Clemensen’s attorney, Jason Call, on 
Monday alleged a lack of due process in the child abuse and neglect 
registry appeals process as a leading reason the judge should enjoin the
 state from listing Clemensen on the registry.&nbsp; 

His child abuse and neglect review 
board hearing took place Nov. 17 and was limited to 20 minutes for each 
side. Clemensen did not have the right to hear witness testimony or 
present evidence, Call said.&nbsp;

Under Missouri <a target="_blank" href="https://casetext.com/regulation/missouri-administrative-code/title-13-department-of-social-services/division-35-childrens-division/chapter-31-child-abuse/section-13-csr-35-31025-child-abuse-and-neglect-review-process">law</a>,
 board hearings are conducted as reviews rather than contested cases, 
and are conducted informally rather than with the rules of evidence 
applying, meaning there is no cross examinations or witness testimony.&nbsp;

Call also said he requested 
Clemensen’s investigative file from Children’s Division in order to 
prepare for the review board hearing and received over 5,000 pages of 
records, nearly 4,000 of which were “completely redacted.”&nbsp;

<a target="_blank" href="https://casetext.com/regulation/missouri-administrative-code/title-13-department-of-social-services/division-35-childrens-division/chapter-31-child-abuse/section-13-csr-35-31025-child-abuse-and-neglect-review-process">Missouri statute</a>
 outlines that Children’s Division should, in fulfilling records 
requests from the alleged perpetrator, redact “any information that may 
identify the reporter of the incident in question,” along with any 
privileged or confidential information that could jeopardize a person’s 
safety.&nbsp;

“How do you defend against something 
when you don’t even know what you’re defending against,” Call asked, 
arguing that the review board did not provide sufficient due process.&nbsp;

“They’ve got to prove these 
allegations actually are true, and that the abuse that they’ve alleged 
actually took place and that it wasn’t part of some rampant plan or 
strategy on the part of a select group of students to try to close the 
school, or motivated by some other improper interest,” Call said.&nbsp;

Rebecca Hamilton, a Children’s 
Division out-of-home investigations supervisor, who testified Monday and
 was in charge of making the findings in Clemensen’s investigation, said
 their findings relied on sources including witness interviews, medical 
records, and child advocacy center interviews. For the physical abuse 
allegations against Clemensen, there were 10 to 15 witnesses, Hamilton 
stated, and there were 16 witnesses in the neglect investigation.&nbsp;

There are only 25 students currently 
living at Agape, Clemensen said Monday, down from 121 in February 2021 
before the social services department and Missouri State Highway Patrol 
launched their investigation.&nbsp;

In <a target="_blank" href="https://missouriindependent.com/2022/09/26/top-missouri-lawmaker-urges-federal-prosecutors-to-intervene-in-agape-abuse-case/">September</a>,
 Agape leadership announced the school’s format would transition to five
 group homes rather than a boarding school type facility.&nbsp;

Now, there are four group homes, and 
they are “about to go down to three,” Clemensen said, because the number
 of enrolled students is low and dwindling.

There was a “mass exodus” of staff at the end of September, Clemensen testified Monday.&nbsp;

“Some of the staff, as they say, ‘saw
 the writing on the wall,’” Clemensen said. There used to be a budget of
 $4 million per year, he said, and now it is $400,000 — quickly adding 
that now, “I’m sure it’s not even that.”&nbsp;

Clemensen’s case was combined with 
the case of another former Agape staff member which was heard Monday, at
 27-year-old named Timas Arya.

The Department of Social Services 
substantiated three physical abuse findings against Arya, who started 
working at Agape in 2017 in various capacities, including as a 
supervisor, and left three months ago.

Arya, who studied at bible college to become a youth pastor, said he feels working with youth is a calling from God.

“I wouldn’t know what else to do,” 
Arya said, if he were placed on the registry and rendered unable to work
 with youth, calling the possibility “devastating.”

In Arya’s case, as well, the majority
 of the investigative file was redacted, which Call said hindered his 
efforts to provide counsel to Arya for the review hearing.&nbsp;

In his closing remarks, Call 
underscored individuals’ “right to chosen employment,” though he and the
 state’s lawyer, Hannah Thomas, disagreed over whether such a right 
exists in statute.&nbsp;

To provide the injunction, 
Clemensen’s legal team must prove the case is likely to succeed on its 
merits, which Thomas argued is unlikely. Thomas also questioned whether 
the court has the authority to enjoin an executive agency.&nbsp;

Judge Stumpe will issue a decision Dec. 21.

The state argued for the “significant public interest” in protecting children, by placing Clemensen and Arya on the registry.&nbsp;

“The outcome is really simple, judge:
 We don’t let child abusers have access to children,” Thomas, the 
state’s attorney, said in her closing remarks.&nbsp;

“This law and the love it defends strike a blow against hate in all its forms," Biden said on the South Lawn of the White House. "And that’s why this law matters to every single American.”

Lawmakers from both parties were there, as well as first lady Jill Biden and Vice President Kamala Harris and her husband, Doug Emhoff. Singers Sam Smith and Cyndi Lauper performed.

“For once, our families, mine and a lot of my friends — and people you know, sometimes your neighbors — we can rest easy tonight, because our families are validated," Lauper said at the White House briefing room before the ceremony.

Senate Majority Leader Chuck Schumer, D-N.Y., wore the same purple tie to the ceremony that he wore to his daughter's wedding. His daughter and her wife are expecting their first child in the spring.

“Thanks to the dogged work of many of my colleagues, my grandchild will live in a world that will respect and honor their mothers' marriage," Schumer said on the Senate floor in the morning.

The triumphant mood played out against the backdrop of&nbsp;<a href="https://apnews.com/article/north-carolina-legislature-gay-rights-raleigh-government-and-politics-84892bee21af98cfd80d56481ca05458">a right-wing backlash</a>&nbsp;over gender issues, which has alarmed gay and transgender people and their advocates. Biden criticized the “callous, cynical laws introduced in the states targeting transgender children, terrifying families and criminalizing doctors who give children the care they need."

“Racism, antisemitism, homophobia, transphobia, they’re all connected," Biden said. “But the antidote to hate is love.”

Among the attendees were the owner of Club Q, a gay nightclub in Colorado where five people were killed in a shooting last month, and two survivors of the attack. The suspect has been&nbsp;<a href="https://apnews.com/article/crime-shootings-colorado-hate-crimes-springs-b9be567920a55986c57af59535ac9f61">charged with hate crimes.</a>

Plaintiffs from lawsuits that originally helped secure the nationwide right to gay marriage were also there.

“It's not lost on me that our struggle for freedom hasn't been achieved," said Kelley Robinson, president of the Human Rights Campaign. "But this is a huge step forward, and we have to celebrate the victories we achieve and use that to fuel the future of the fight.”

Robinson attended the ceremony with her wife and 1-year-old child.

“Our kids are watching this moment,” she said. “It's very special to have them here and show them that we're on the right side of history.”

The new law is intended to safeguard gay marriages if the U.S. Supreme Court ever reverses Obergefell v. Hodges, its&nbsp;<a href="https://apnews.com/article/marriage-anthony-kennedy-ohio-state-government-united-states-tennessee-9dc57b83f3ae2fc7d2e007aa80bf33a3">2015 decision legalizing same-sex unions nationwide</a>. The new law also protects interracial marriages. In 1967, the Supreme Court in&nbsp;<a href="https://apnews.com/article/north-america-us-news-ap-top-news-courts-supreme-courts-c6df18d20eb141e1b55bd5c3b02bf91d">Loving v. Virginia</a>&nbsp;struck down laws in 16 states barring interracial marriage.

The signing marks the culmination of&nbsp;<a href="https://apnews.com/article/politics-wisconsin-rob-portman-marriage-tammy-baldwin-91b12650871afaa87a479d3018a4fded">a monthslong bipartisan effort</a>&nbsp;sparked by the Supreme Court’s decision in June to overturn Roe v. Wade, the 1973 ruling that made abortion available across the country.

In a concurring opinion in the case that overturned Roe, Justice Clarence Thomas suggested revisiting other decisions, including the legalization of gay marriage, generating fear that more civil rights could be imperiled by the court’s conservative majority. Thomas did not include interracial marriage with other cases he said should be reconsidered.

Lawmakers crafted a compromise that was intended to assuage conservative concerns about religious liberty, such as ensuring churches could still refuse to perform gay marriages.

In addition, states will not be required to issue marriage licenses to same-sex couples. But they will be required to recognize marriages conducted elsewhere in the country.

A majority of Republicans in Congress still voted against the legislation. However, enough supported it to sidestep a filibuster in the Senate and ensure its passage.

Tuesday’s ceremony marks another chapter in&nbsp;<a href="https://apnews.com/article/biden-politics-ohio-state-government-and-texas-4d369bd85e52b030ff1813dcafc9f7bd">Biden’s legacy on gay rights.</a>

He memorably — and unexpectedly — endorsed same-sex unions in a television interview in 2012, when he was vice president. Days later, President Barack Obama announced that he also supported gay marriage.

A clip of the interview was played at the ceremony.

"What this is all about is a simple proposition: Who do you love?" Biden said on NBC's “Meet the Press" a decade ago. "Who do you love and will you be loyal to the person you love? And that is what people are finding out is what all marriages at their root are about."

A Gallup poll showed only 27% of U.S. adults supported same-sex unions in 1996, when President Bill Clinton signed the Defense of Marriage Act, which said the federal government would only recognize heterosexual marriages. Biden voted for the legislation.

By the time of Biden's 2012 interview, gay marriage remained controversial, but support had expanded to roughly half of U.S. adults, according to Gallup. Earlier this year, 71% said same-sex unions should be recognized by law.

Biden has pushed to expand LGBT rights since taking office. He reversed President Donald Trump’s efforts to strip transgender people of anti-discrimination protections. In August 2022, a federal jury convicted Bruce Hay, 54, of Greeley, a U.S. Army veteran, of six counts of wire fraud and 10 counts of theft of government funds. Hay misrepresented and exaggerated the extent of symptoms related to a purported conversion disorder diagnosis to receive more than $500,000 in VA disability benefits to which he was not entitled.

“Misrepresenting symptoms to the VA to fraudulently obtain benefits takes resources from deserving veterans and will not be tolerated,” said Special Agent in Charge Gregory Billingsley with the Department of Veterans Affairs Office of Inspector General’s Central Field Office. “The VA OIG will continue to vigorously investigate those who would steal from VA benefits programs and taxpayers.”

TOPEKA, Kan. (AP) — The company operating a pipeline that leaked about 14,000 bathtubs' worth of crude oil into a northeastern Kansas creek is recovering at least a small part of it from what was the largest onshore crude oil spill in nine years.

The U.S. Environmental Protection Agency said Tuesday that Canada-based TC Energy has recovered 2,163 barrels of oil mixed with water from the 14,000-barrel&nbsp;<a href="https://apnews.com/article/oil-spills-business-texas-canada-kansas-34d8391337583fc242407141d24d66c2">spill on a creek</a>&nbsp;running through rural pastureland in Washington County, Kansas, about 150 miles northwest of Kansas City.

The EPA also said the company has recovered 435 barrels from the ruptured pipeline, to bring the total amount of oil and water recovered to 2,598 barrels, a figure also released by the company. Each barrel is enough to fill a household bathtub, and the total spill was 588,000 gallons.

Last week's rupture in Kansas forced the company to shut down the Keystone system, and it hasn't said when it will come back online. It is using trucks with what essentially are large wet vacuums to suck out the oil. The company said Thursday evening that the trucks are operating around the clock. The company and the EPA say no drinking water was affected, and no one was evacuated in the wake of the spill.

“Our commitment to the community is that our response efforts will continue until we have fully remediated the site,” the company said in a statement.

The company used booms, or barriers, to contain the oil in the creek and also built an earthen dam to prevent it from moving into larger waterways. The EPA said the company built a second earthen dam to helps support the first.

The spill prompted the U.S. Department of Transportation's pipeline safety arm&nbsp;<a href="https://www.phmsa.dot.gov/sites/phmsa.dot.gov/files/2022-12/TC%20Oil%20CAO.3-2022-074.pdf">to order TC Energy to take corrective action.</a>

It said the company must reduce the operating pressure by 20% inside the 96-mile (155-kilometer) segment running from Steele City, Nebraska, south to Hope, Kansas. It also said the company cannot restart operations in that segment without the permission of the pipeline safety regulators.

The company also must identify the root cause of the spill and submit a plan for finding similar problems elsewhere and conducting additional tests by early March.

Bill Caram, executive director of the advocacy Pipeline Safety Trust, said much of the order is standard “boilerplate,” and it would be possible for TC Energy to get the 96-mile segment back online once it does a repair.

“They need to excavate the pipe in such a way that it's preserved just for the investigation, for that root-cause analysis, and that takes probably the most time,” Caram said. “But the actual repair can be pretty quick.”

Concerns that spills could pollute waterways spurred opposition to plans by TC Energy to build another crude oil pipeline in the Keystone system, the 1,200-mile Keystone XL, which would have cut across Montana, South Dakota and Nebraska. Critics also argued that using crude from western Canada’s oil sands would worsen climate change, and President Joe Biden’s cancelation of a U.S. permit for the project led the company to&nbsp;<a href="https://apnews.com/article/donald-trump-joe-biden-keystone-pipeline-canada-environment-and-nature-141eabd7cca6449dfbd2dab8165812f2">pull the plug last year</a>.

Company starting to recover oil from Kansas pipeline spill

WASHINGTON (AP) — Scientists announced Tuesday that they have for the first time produced more energy in a fusion reaction than was used to ignite it — a major breakthrough in the&nbsp;<a href="https://apnews.com/article/science-climate-and-environment-effacd249a42e43b9a54b28d4655b346">decades-long quest to harness</a>&nbsp;the process that powers the sun.

Net energy gain has been an elusive goal because fusion happens at such high temperatures and pressures that it is incredibly difficult to control.

The breakthrough will pave the way for advancements in national defense and the future of clean power, Energy Secretary Jennifer Granholm and other officials said.

“Ignition allows us to replicate for the first time certain conditions that are found only in the stars and the sun,'' Granholm told a news conference in Washington. "This milestone moves us one significant step closer to the possibility of zero-carbon abundant fusion energy powering our society.''

Fusion ignition is “one of the most impressive scientific feats of the 21st century,″ Granholm said, adding that the breakthrough “will go down in the history books.″

Appearing with Granholm, White House science adviser Arati Prabhakar called the fusion ignition “a tremendous example of what perseverance really can achieve" and "an engineering marvel beyond belief.''

Proponents of fusion hope that it could one day offer nearly limitless, carbon-free energy and displace fossil fuels and other traditional energy sources. Producing energy that powers homes and businesses from fusion is still decades away. But researchers said the announcement marked a significant advance nonetheless.

“It’s almost like it’s a starting gun going off,” said professor Dennis Whyte, director of the Plasma Science and Fusion Center at the Massachusetts Institute of Technology and a leader in fusion research. "We should be pushing towards making fusion energy systems available to tackle climate change and energy security.”

Kim Budil, director of the Livermore Lab, said there are “very significant hurdles” to commercial use of fusion technology, but advances in recent years mean the technology is likely to be widely used in “a few decades” rather than 50 or 60 years as previously expected.

Fusion works by pressing hydrogen atoms into each other with such force that they combine into helium, releasing enormous amounts of energy and heat. Unlike other nuclear reactions, it doesn't create radioactive waste.

President Joe Biden called the breakthrough a good example of the need to continue to invest in research and development. “Look what’s going on from the Department of Energy on the nuclear front. There’s a lot of good news on the horizon,” he said at the White House.

Billions of dollars and decades of work have gone into fusion research that has produced exhilarating results — for fractions of a second. Previously, researchers at the National Ignition Facility, the division of Lawrence Livermore where the success took place, used 192 lasers and temperatures multiple times hotter than the center of the sun to&nbsp;<a href="https://apnews.com/article/science-fusion-energy-lawrence-livermore-a3c1ecbb738640b0a2e384dc80b8dd07">create an extremely brief fusion reaction</a>.

The lasers focus an enormous amount of heat on a small metal can. The result is a superheated plasma environment where fusion may occur.

Riccardo Betti, a professor at the University of Rochester and expert in laser fusion, said there's a long road ahead before the net energy gain leads to sustainable electricity.

He likened the breakthrough to when humans first learned that refining oil into gasoline and igniting it could produce an explosion.

“You still don't have the engine, and you still don't have the tires,” Betti said. “You can't say that you have a car.”

The net energy gain achievement applied to the fusion reaction itself, not the total amount of power it took to operate the lasers and run the project. For fusion to be viable, it will need to produce significantly more power and for longer.

It is incredibly difficult to control the physics of stars. Whyte said the fuel has to be hotter than the center of the sun. The fuel does not want to stay hot — it wants to leak out and get cold. Containing it is a challenge, he said.
