JEFFERSON COUNTY —A Kansas man died in an accident just after 4p.m. Wednesday in Jefferson County.

The Kansas Highway&nbsp; Patrol reported a 2022 Harley Davidson motorcycle driven byMichael J. Schecher, 59, Holton, northbound on U.S. 59 just north of Kansas 16.&nbsp; The driver attempted to pass a northbound 2022 GMC Savanna van driven by John G.&nbsp;Morris, 29, Topeka, who was slowing to make a left turn into a private driver.

The van struck the motorcycle. Schecher was pronounced dead at the scene and was transported to Barnett Family Funeral Home in Oskaloosa. Morris was not injured.&nbsp; Schecher was not wearing a helmet, according to the KHP.

LIVINGSTON COUNTY —One person was injured in an accident just before 10:30a.m. Wednesday in Livingston County.

The Missouri State Highway Patrol reported a 2001 Ford Explorer driven by Angela M. Lowrey, 51, Trenton, was northbound on Route V at LIV 200.

The SUV traveled off the south side of the road while navigating a curve. The driver overcorrected and the vehicle traveled off the north side of the road and overturned onto its top.

Livingston County ambulance transported Lowrey and a passenger Francis L. Untiedt, 75, Trenton, to Wright Memorial Hospital. They were not wearing seat belts, according to the MSHP.

Mo. man, woman injured after SUV rolls onto its top

ATCHISON COUNTY—Law enforcement in northeast Kansas are investigating a Kansas felon on new allegations.

Just before 10a.m. Tuesday, officers responded to the area of 15th and Kansas Avenue in Atchison to investigate a threat that had been made by a person riding a bicycle, according to Police Chief Mike Wilson.

Officers located that person, 34-year-old Jesse Ferris, in the 1300 block Kansas Avenue. He was found to be in possession of methamphetamine and drug paraphernalia and taken into custody on requested drug charges. 

The case involving the threat remains under investigation.&nbsp; Ferris has previous convictions for theft, burglary and drugs, according to the Kansas Department of Corrections.

Kansas felon riding a bike was caught transporting drugs

ATCHISON COUNTY —Two people were injured in an accident just after 5a.m. Wednesday in Atchison County.

The Kansas Highway Patrol reported a 2022 Toyota Corolla driven by Emmanuel I. Nnuekwe, 24, Charleston, Illinois, was northeastbound on U.S. 59 two miles northeast of Nortonville 

The car traveled left of center and struck a southwest bound 2020 Kenworth semi driven by Darrel Wayne Johnson, 62, St. Joseph, head-on.

After impact the semi traveled into the northwest ditch, struck an embankment, rolled onto its side and struck a power pole.

EMS transported Nnuekwe to KU Medical Center and Johnson to Amberwell in Atchison. Both drivers were properly restrained, according to the KHP.

A Robidoux Middle School math teacher accused of sexually
assaulting a 14-year-old student has been fired by the St. Joseph School Board.

The Buchanan County Prosecuting Attorney’s office has filed a
charge of first-degree sodomy against Everett “Tim” Harding of Maryville.

The St. Joseph Board of Education, during its Tuesday meeting,
terminated Harding’s contract with the district.

The district issued a statement, “Upon hearing concerns,
the District placed the former employee on leave, thoroughly investigated, and
contacted and coordinated with the appropriate agencies and law enforcement in
their investigations.&nbsp;The District will continue cooperating with those
agencies regarding their investigations.”

A probable cause statement accuses Harding to being alone in
his classroom for nearly an hour with a 14-year-old girl, who he allegedly
sexually assaulted. The statement also said other staff members at the middle
school witnessed and reported inappropriate behavior leading up to the
incident.

St. Joseph teacher accused of sexually assaulting student fired

The St. Joseph Police Department is in mourning.&nbsp;Captain Jeff Wilson acknowledges the painful and sudden loss of officer Kyle Graham, who took his own life this past Thursday. He was just 40 years old.

"This is an extremely tough time for our department and tenfold for his family."

In light of Graham’s death, Wilson is sharing with the public the importance of officer wellness. Starting by defining the word wellness itself.

"Wellness is something we've focused on for quite a long time," he said. "We term it as mental fitness, physical fitness and spiritual fitness."

Wilson has been an officer for 32 years. He says when he first started, mental health was something that just wasn’t talked about in law enforcement. It was all about "acting tough" or "bulletproof."

Today, Wilson has faith in St. Joseph Police leadership and other agencies' ability to properly address the topic.

"Our law enforcement leaders have gotten much better at recognizing the importance of officer wellness," he pointed out. "The ability for an officer to do this job. Which, by the way, is considered to be the most physically and mentally dangerous and traumatizing profession you could be involved in."

After Graham’s death, Wilson says the best way to honor their fallen officer and brother is to address officer wellness head on.

While the dialogue is opening up and the stigma is changing, Wilson points out there's work to be done with an an average of 184 law enforcement suicides in the United States per year.

"I know that's what Kyle would've wanted," Wilson said. "For us to figure out what we can do for his fellow officers on this department and across the country. And that's our goal here."

Wilson says St. Joseph Police has resources in place for officers during times of trauma, or after a traumatic event. One is a peer support group.

"Our peer support group made up of 10 trained officers, and it's a group of folks our officers can go and talk to," Wilson said. "They can talk to people, officers who understand where they're coming from. They share the same turf, so to speak."

The Family Guidance Center of St. Joseph also provides liaisons to officers - during difficult times and also on a day-to-day basis as needed.

Wilson commends chief Paul Luster, who Wilson says has prioritized the mental health of officers on the force.

"His greatest concern is the wellbeing of our officers," Wilson said of Luster. "Their mental state and where they're at. That's because he has a mission and a vision for our department and what he wants our officers to do, and we have to be okay to go out there and help other people be okay."

As for Graham's memory, Wilson says the entire force will remember him for his upbeat attitude and diligent work.

"It's a terrible loss to this department," Wilson reiterated. "Officer Graham wore this badge, which represents this noble profession, with a public servant mindset and heart. A public servant heart. Each and everyday, he went out to do his job."

Funeral services for Graham will be held this coming Monday at Word of Life Church in St. Joseph. Visitation will be from 3-5 p.m. on Sunday at Meierhoffer Funeral Home.

St. Joseph Police mourning loss of fallen officer, addressing importance of wellness

A preliminary report from the St. Joseph School District showed a slight decrease in student attendance.  

The report shows attendance dropped from a bit more than 78-percent to just above 77 percent, still well below the attendance goal of 90-percent.  

Superintendent Gabe Edgar says while ideas bounce around to improve attendance, one thing that will continue is working with the Buchanan County Prosecutors Office. 

"Right now, it's not showing a whole lot of progress, but I think that moving into the future this is just something that takes time, and fortunately we didn't go backwards," Edgar tells KFEQ Hotline host Barry Birr.  

Edgar says a bright spot on the report, however, was a 10-percent increase in the district’s graduation rate. 

"Obviously that's the end goal for every kid, at the end of the day you want them to graduate from high school, and so we're very proud of that accomplishment," Edgar says. 

Edgar says while there was a focus on students in that graduation age, internal discussions continue of how the district should move forward 

"My philosophical belief is that our interventions need to come way early, the interventions need to start in the kindergarten, the first grade, the second grade," Edgar explains. "I'm not saying we need to not pay attention to what's going on in the ninth, tenth, and eleventh, but we really need to build that relationship early to help, not only the students, but also the parents understand the value of education." 

The final, official report is expected sometime in October.

St. Joseph School District has good news, bad news, in preliminary report

NODAWAY COUNTY—One person was injured in an accident and later arrested just before 6p.m. Tuesday in Nodaway&nbsp; County.

The Missouri State Highway Patrol reported a 2017 Chevy Malibu driven by Jennifer E. Osborn, 47, Ravenwood, was southbound on MO 46 just south of Bishop Street in Ravenwood.

The car traveled off the west side of the road and struck numerous mail boxes, a fire hydrant and overturned. The car came to rest on its top in the front yard of a home.

Osborn was arrested on requested charges of DWI drugs and operating a vehicle in a careless and imprudent manner involving an accident.

Nodaway County EMS then transported her to Mosaic in Maryville. She was properly restrained, according to the MSHP.

Mo. woman accused of DWI after injured in violent car crash

BROWN COUNTY—Law enforcement authorities are investigating a Kansas couple on multiple drug allegations.

Just before 11p.m. Saturday, a Brown County deputy requested the sheriff's department K-9 Carla be deployed on a traffic stop on K-20 Highway near Falcon Road, according to Sheriff John Merchant.

Carla indicated on the vehicle and based off of information gathered at the scene, a search warrant was applied for and granted for a residence located at 250 E. 8th Street in Horton.

The Brown County Sheriff's Office Drug Task Force initiated the Search Warrant and drug related items were taken into custody as evidence. At the conclusion of the Warrant, Glenda Mendez, 49, Horton was arrested on requested charges of Possession of Meth, Possession of Drug Paraphernalia, Felony Obstruction and Child Endangerment.&nbsp; 

Tyrone Mendez, 47,&nbsp; Horton was arrested on requested charges of Possession of Meth, Possession of Marijuana, Possession of Drug Paraphernalia and Child Endangerment.&nbsp;&nbsp;

Parents jailed after drugs, children found at Kansas home

Judge rules that Blue Springs School District discriminated against former student by barring him from boys’ locker room

After a decade-long legal battle, a transgender man and former student of the Blue Springs School District should receive over $4 million in damages for discrimination that occurred when he was an adolescent, the Missouri’s Western District Court of Appeals ruled Tuesday.

Judge Anthony Gabbert wrote the court’s unanimous decision, ruling that the school district discriminated against the student, identified by his initials R.M.A., on the basis of sex when it barred him from using the boys’ locker room.

A key part of the appellate court’s decision was the factor that spurred the school district’s discrimination.

Attorneys for the Blue Spring School District did not contest that R.M.A. was treated differently, according to Gabbert’s ruling, but said it was because of his “female genitalia.”

“School district employees suggested that R.M.A. had been excluded from the boys’ restrooms and locker rooms because of [the] school district’s belief that he had female genitalia,” Gabbert wrote. “[The] school district did not actually determine the nature of R.M.A.’s genitalia, however, and does not speculate, inspect or otherwise inquire as to the genitalia of other male students.”

The admission of different treatment based on assumed genitalia, Gabbert wrote, was itself discrimination on the basis of sex.

Part of the judicial proceedings included testimony from R.M.A.’s doctor, who said R.M.A. was a male for as long as she has been treating him (which began at age nine).

During his time as a student, R.M.A. received an updated birth certificate with his male gender identity.

School district employees and school board members told R.M.A.’s mother that locker-room access is determined by birth certificate. After she gave the corrected birth certificate to school district officials, R.M.A. was still denied access to boys’ restrooms and locker rooms.

The school board discussed R.M.A’s birth certificate in a closed-door meeting, according to court documents, but never gave his mother a clear answer about the policy.

“The evidence at trial… was that (Blue Springs) School District had an unwritten policy of using birth certificates to determine sex,” Gabbert wrote. “Yet, [the] school district refused to tell R.M.A.’s mother that it would honor a corrected birth certificate stating he is male because (it) wanted to keep its options open in the event R.M.A. was able to obtain a corrected birth certificate.”

R.M.A’s birth certificate was amended in December 2014, around a year after he began asking to use the locker room that aligned with his gender identity and two months after he filed a complaint with the Missouri Commission on Human Rights.

R.M.A. filed the lawsuit in October 2015, starting a complicated legal process. The initial trial court dismissed his claim in 2016, saying the Missouri Human Rights Act does not protect claims on the basis of gender identity. The Missouri Supreme Court, in 2019,&nbsp;<a target="_blank" href="https://www.kansascity.com/news/local/article226814519.html">reversed this decision</a>&nbsp;and opened the doors for another trial.

A December 2021 jury trial awarded R.M.A. over $4.7 million in damages and legal fees, but attorneys for the Blue Springs School District asked for a “judgment notwithstanding the verdict,” a ruling that allows a judge to usurp a jury’s decision.&nbsp;

The school district argued that R.M.A. only proved that he was discriminated against “because of his female genitalia” and not on the basis of sex.

The&nbsp;<a target="_blank" href="https://www.kcur.org/news/2022-06-07/judge-throws-out-a-jurys-4-million-verdict-in-favor-of-a-blue-springs-transgender-student">trial court judge sided with the school district</a>, which would have spurred another trial. But Tuesday’s decision reverses that judge’s call, returning the case back to the jury’s verdict.

There are other similar cases currently winding through Missouri’s courts, including a&nbsp;<a target="_blank" href="https://missouriindependent.com/2023/08/01/aclu-sues-missouri-school-district-for-transgender-bathroom-policy/">lawsuit against the Platte County School District</a>&nbsp;brought by the ACLU of Missouri.

The Blue Springs School District could not be reached for comment by time of publication.

 </figure>BY:&nbsp;ANNELISE HANSHAW&nbsp;<a href="https://missouriindependent.com/2022/09/21/missouri-judge-once-again-delays-decision-on-closing-agape-boarding-school/">Missouri Independent</a><h2>Judge rules that Blue Springs School District discriminated against former student by barring him from boys’ locker room</h2>After a decade-long legal battle, a transgender man and former student of the Blue Springs School District should receive over $4 million in damages for discrimination that occurred when he was an adolescent, the Missouri’s Western District Court of Appeals ruled Tuesday.Judge Anthony Gabbert wrote the court’s unanimous decision, ruling that the school district discriminated against the student, identified by his initials R.M.A., on the basis of sex when it barred him from using the boys’ locker room.A key part of the appellate court’s decision was the factor that spurred the school district’s discrimination.Attorneys for the Blue Spring School District did not contest that R.M.A. was treated differently, according to Gabbert’s ruling, but said it was because of his “female genitalia.”“School district employees suggested that R.M.A. had been excluded from the boys’ restrooms and locker rooms because of [the] school district’s belief that he had female genitalia,” Gabbert wrote. “[The] school district did not actually determine the nature of R.M.A.’s genitalia, however, and does not speculate, inspect or otherwise inquire as to the genitalia of other male students.”The admission of different treatment based on assumed genitalia, Gabbert wrote, was itself discrimination on the basis of sex.<h2>Let us know what you think...</h2>Part of the judicial proceedings included testimony from R.M.A.’s doctor, who said R.M.A. was a male for as long as she has been treating him (which began at age nine).During his time as a student, R.M.A. received an updated birth certificate with his male gender identity.School district employees and school board members told R.M.A.’s mother that locker-room access is determined by birth certificate. After she gave the corrected birth certificate to school district officials, R.M.A. was still denied access to boys’ restrooms and locker rooms.The school board discussed R.M.A’s birth certificate in a closed-door meeting, according to court documents, but never gave his mother a clear answer about the policy.“The evidence at trial… was that (Blue Springs) School District had an unwritten policy of using birth certificates to determine sex,” Gabbert wrote. “Yet, [the] school district refused to tell R.M.A.’s mother that it would honor a corrected birth certificate stating he is male because (it) wanted to keep its options open in the event R.M.A. was able to obtain a corrected birth certificate.”R.M.A’s birth certificate was amended in December 2014, around a year after he began asking to use the locker room that aligned with his gender identity and two months after he filed a complaint with the Missouri Commission on Human Rights.R.M.A. filed the lawsuit in October 2015, starting a complicated legal process. The initial trial court dismissed his claim in 2016, saying the Missouri Human Rights Act does not protect claims on the basis of gender identity. The Missouri Supreme Court, in 2019,&nbsp;<a target="_blank" href="https://www.kansascity.com/news/local/article226814519.html">reversed this decision</a>&nbsp;and opened the doors for another trial.A December 2021 jury trial awarded R.M.A. over $4.7 million in damages and legal fees, but attorneys for the Blue Springs School District asked for a “judgment notwithstanding the verdict,” a ruling that allows a judge to usurp a jury’s decision.&nbsp;The school district argued that R.M.A. only proved that he was discriminated against “because of his female genitalia” and not on the basis of sex.The&nbsp;<a target="_blank" href="https://www.kcur.org/news/2022-06-07/judge-throws-out-a-jurys-4-million-verdict-in-favor-of-a-blue-springs-transgender-student">trial court judge sided with the school district</a>, which would have spurred another trial. But Tuesday’s decision reverses that judge’s call, returning the case back to the jury’s verdict.There are other similar cases currently winding through Missouri’s courts, including a&nbsp;<a target="_blank" href="https://missouriindependent.com/2023/08/01/aclu-sues-missouri-school-district-for-transgender-bathroom-policy/">lawsuit against the Platte County School District</a>&nbsp;brought by the ACLU of Missouri.The Blue Springs School District could not be reached for comment by time of publication.

Missouri court sides with transgender student in $4 million discrimination case

An extra $220 million dollars has been added to the National
Defense Authorization Act by the House Armed Services Committee, enough money
for two additional C-130J planes.

Northern Missouri Congressman Sam Graves sponsored the
amendment, hoping those new, modern cargo planes go to the Air National Guard’s
139th Airlift Wing based as Rosecrans Memorial Airport.

“In the base text of the bill, there was no new money for
C-130Js. And so, I did offer an amendment to pull two in,” Graves tells KFEQ/St.
Joseph Post. “Hopefully, those are going to end up in St. Joe. I’m doing everything
I can to see those end in St. Joe and our folks out at the 139th
Airlift Wing are doing everything that they can.”

The Missouri General Assembly allocated $7 1/2 million for the design and construction of an aircraft maintenance facility for the 139th as well as $4 million for a fuel station at Rosecrans. St. Joseph city and Buchanan County officials have contributed money to make improvements at Rosecrans.

Graves
says such contributions make an impression on Washington.

“The Pentagon will see that there’s a lot of support behind
this,” Graves says. “They are not the only ones that are going to be putting money
behind improving the base and making sure that it is state-of-art and has
everything that the Defense Department needs in that facility. Everything
helps. Everybody’s pulling together.”

A new main runway has been constructed at Rosecrans. Construction
is underway to build a new terminal and air traffic control tower at the St.
Joseph airport. The old tower is outdated and doesn’t meet National Air Guard
standards.

Landing the C130J model cargo plane is seen as vital to the
139th Airlift Wing’s future in St. Joseph. The modern planes would
replace the fleet of C-13oH planes now at the 139th base. Graves
says Rosecrans barely missed the cut for receiving the new planes during the
first allocation by the Secretary of the Air Force and Director of the Air
National Guard and likely remains a top base for consideration of the new aircraft.

Graves is pleased the entire Missouri Congressional delegation
has come together to push for the 139th to get the new planes and
has been joined by city, county, and state officials to pour money into
improvements at Rosecrans.

“I think that we can make the case and we’re going to continue
to push and this fight, it’s not over,” according to Graves. “We’re just going
to keep working it and working it and working it until we achieve what we’re trying
to achieve.” 

Graves says everyone is working off the checklist provided by
the Pentagon that disclosed deficiencies that need to be addressed at Rosecrans
for the 139th to be awarded the new version of the C-130 cargo
planes.

The 139th not only flies the C-130 cargo planes on
missions throughout the world, it also trains pilots from throughout the world.
The Advanced Airlift Tactics Training Center at Rosecrans trains C-130 pilots
from throughout the United States as well as pilots from America’s allies,
especially members of NATO.

Efforts to land new cargo planes at the 139th Airlift Wing get boost

The specter of immigrants voting illegally has become a election-year talking point for Republicans across the country

Missouri’s Constitution has&nbsp;<a target="_blank" href="https://law.justia.com/constitution/missouri/article-viii/section-2/">banned noncitizens from voting</a>&nbsp;since 1924. And state law requires individuals to&nbsp;<a target="_blank" href="https://law.justia.com/codes/missouri/title-ix/chapter-115/section-115-155/">verify they are a U.S. citizen</a>&nbsp;in order to register to vote.&nbsp;

But GOP lawmakers contend the constitutional and statutory language isn’t strong enough. Instead of saying that “all citizens” can vote, Republicans argue the state constitution should be changed to make it clear that “only citizens” can vote.&nbsp;

So on the final day of the 2024 legislative session last month, the GOP pushed through a proposal that would, among other things, ask voters to&nbsp;<a target="_blank" href="https://www.senate.mo.gov/24info/BTS_Web/Bill.aspx?SessionType=R&amp;BillID=433">change “all” to “only.”</a>&nbsp;

“If they become a citizen, then absolutely I would welcome their engagement in our electoral process,” state Sen. Ben Brown, a Republican from Washington, said while presenting the bill to a House committee. “However, what I aim to do is to prevent the dilution of the voice of U.S. citizens.”

Critics painted the proposal as nothing more than “ballot candy” designed to stoke anti-immigrant sentiment and trick voters into signing off on the amendment’s other provision — a ban on ranked-choice voting.&nbsp;

Marilyn McLeod, president of the League of Women Voters of Missouri, called the proposal a “red herring” at a legislative hearing last month.&nbsp;&nbsp;

“It’s already against the law,” she said.&nbsp;

The idea that noncitizens could be illegally voting has become&nbsp;<a target="_blank" href="https://michiganadvance.com/2024/05/28/u-s-house-panel-votes-to-advance-election-bills-targeting-noncitizens-foreign-money/">an election-year talking point</a>&nbsp;for Republicans across the country, often echoing the baseless conspiracy theory spread by former President Donald Trump that millions of undocumented immigrants voted in the 2016 election.&nbsp;

A nationwide survey by the Brennan Center for Justice found the number of noncitizens suspected to have voted in the 2016 election was only<a target="_blank" href="https://www.brennancenter.org/our-work/research-reports/noncitizen-voting-missing-millions">&nbsp;around 30</a>.&nbsp;A national&nbsp;<a target="_blank" href="https://www.heritage.org/voterfraud/search?combine=&amp;state=All&amp;year=&amp;case_type=All&amp;fraud_type=24491">database</a>&nbsp;run by The Heritage Foundation, a conservative think tank, shows that there have been fewer than 100 cases of voter fraud tied to noncitizens since 2002, according to a&nbsp;<a target="_blank" href="https://www.washingtonpost.com/politics/2024/03/06/truth-about-noncitizen-voting-federal-elections/">recent count</a>&nbsp;by The Washington Post.

The Ohio Secretary of State’s Office this year announced&nbsp;<a target="_blank" href="https://www.ohiosos.gov/media-center/press-releases/2024/2024-05-14a/">only 137 suspected noncitizens</a>&nbsp;were discovered to be on that state’s rolls out of roughly 8 million voters. And the Georgia Secretary of State’s Office found that&nbsp;<a target="_blank" href="https://sos.ga.gov/news/secretary-raffensperger-refers-1600-noncitizen-registrants-local-das-gbi-state-election-board">1,634 noncitizens attempted to register to vote</a>&nbsp;over a 25 year period, but all had been blocked by local election officials.&nbsp;

Yet in some states, even though noncitizens are prohibited from voting in federal elections, they have been permitted to cast a ballot for local candidates.&nbsp;

In&nbsp;<a target="_blank" href="https://ballotpedia.org/Laws_permitting_noncitizens_to_vote_in_the_United_States">16 cities and towns</a>&nbsp;in California, Maryland and Vermont, noncitizens are allowed to vote in some local elections, such as for school board or city council. In 2022, New York’s State Supreme Court&nbsp;<a target="_blank" href="https://www.nytimes.com/2022/06/27/nyregion/noncitizen-voting-ruling-nyc.html">struck down</a>&nbsp;New York City’s 2021 ordinance that allowed noncitizens to vote in local elections, ruling it violated the state constitution.

State Sen. Bill Eigel, a Weldon Spring Republican and a candidate for governor, said the language in the Missouri Constitution designed to prohibit noncitizen voting is similar to other states where the practice is taking place locally.&nbsp;

He believes Democrats in Missouri could follow suit.

“So do I think that if (St. Louis) Mayor Tishaura Jones thought that there was an opportunity to start engaging noncitizens to vote in local St. Louis city municipal elections, would she do it using the same procedure that’s happened to these other states?” he said. “I absolutely think she would. So for me, it’s important to put these additional protections in the constitution.”&nbsp;

In 1865, Missouri voters approved a new constitution&nbsp;<a target="_blank" href="https://www.columbiatribune.com/story/news/2015/01/11/150-years-ago-missouri-state/21743565007/">abolishing slavery</a>. The&nbsp;<a target="_blank" href="https://scholarship.law.missouri.edu/cgi/viewcontent.cgi?article=1001&amp;context=mo_constitutions_race">1865 “Drake Constitution,”</a>&nbsp;written by what were called Radical Republicans, took the vote away from former Confederates and extended it to immigrants who were not yet citizens but who had declared their intent to become one.

The provision rewarded the largest immigrant group in Missouri at the time, Germans, who were among the most anti-slavery, and therefore Radical Republican voters.&nbsp;

The franchise was&nbsp;<a target="_blank" href="https://cdm16795.contentdm.oclc.org/digital/collection/p16795coll26/id/23750/rec/34">taken away from noncitizens in 1924</a>, when newcomers were more likely to come from eastern and southern Europe, in an amendment proposed by a state Constitutional Convention&nbsp;<a target="_blank" href="https://mdh.contentdm.oclc.org/digital/collection/bluebook/id/12864/rec/25">passed with 53.5%</a>&nbsp;of the vote.

In addition to the century-old constitutional prohibition, state law also requires Missourians to&nbsp;<a target="_blank" href="https://law.justia.com/codes/missouri/title-ix/chapter-115/section-115-155/">declare whether they are a U.S. citizen</a>&nbsp;when registering to vote. And Missouri Secretary of State Jay Aschroft, a Republican and candidate for governor, has repeatedly clarified over the years that state law says “<a target="_blank" href="https://www.kansascity.com/news/politics-government/article242407526.html">you have to be a citizen to register to vote</a>.”

Much of Missouri’s debate this year about noncitizen voting took place as part of a session-long fight over a Republican push to make it harder to amend the state constitution through the initiative petition process.&nbsp;

A campaign to legalize abortion up to the point of fetal viability submitted more than 380,000 signatures to the Missouri Secretary of State’s office, paving the way for the proposed constitutional amendment to potentially land on the November ballot.

In response, Republicans hoped to raise the threshold for amending the constitution from a simple majority statewide to both a majority of votes statewide and a majority of votes in five of the state’s eight congressional districts.

Under that proposal, approximately 23% of voters could theoretically control the outcome, where a&nbsp;<a target="_blank" href="https://missouriindependent.com/2024/02/05/as-few-as-1-in-5-voters-could-defeat-initiative-petitions-under-missouri-senate-proposal/">vote against an amendment in four districts would be enough to defeat it statewide</a>.

Many Republican proponents of raising the bar for amending the constitution acknowledged its chances of winning voter approval was slim.&nbsp;

“Raising the threshold is a loser and various states have proven that’s a loser,” Tim Jones, state director of the Missouri Freedom Caucus,&nbsp;<a target="_blank" href="https://missouriindependent.com/2024/02/05/as-few-as-1-in-5-voters-could-defeat-initiative-petitions-under-missouri-senate-proposal/">said earlier this year</a>.&nbsp;

So to bolster the amendment’s chances, Republicans added the noncitizen voting provision.&nbsp;

Senate Democrats refused to allow the proposal to go to the ballot with the noncitizen language, arguing it was deceptive. They staged&nbsp;<a target="_blank" href="https://missouriindependent.com/2024/05/15/50-hour-filibuster-forces-more-negotiations-on-gop-backed-initiative-petition-changes/">a 50-hour filibuster&nbsp;</a>that ultimately killed the proposal amid Republican infighting.&nbsp;

“It’s in there to deceive voters,” state Sen. Karla May, a St. Louis Democrat, said during the filibuster about the noncitizen voting ban. “It’s already law, but they want to trick voters into thinking it’s not law. It’s deceiving language added to the bill.”

Gov. Mike Parson, a Republican, seemed to agree, telling a reporter from&nbsp;<a target="_blank" href="https://x.com/EmilyManleyTV/status/1790534660918743202">Nextar Media Group</a>&nbsp;that “it’s already illegal for an illegal to vote in the state of Missouri. We’ve already got that part.”

With the Senate mired in gridlock, the House picked up and&nbsp;<a target="_blank" href="https://missouriindependent.com/briefs/ranked-choice-voting-missouri-ballot/">passed the rank-choice voting amendment</a>&nbsp;that included noncitizen provision. After months of heated debate over the issue, it was barely mentioned when the rank-choice voting ban was sent to the ballot on the session’s final day.

“It seems like we’ve been wringing our hands for about a week or two on this particular issue,” state Rep. Brad Banderman, a St. Clair Republican, said during the House debate, “but on this day, on this Senate Joint Resolution, the other side of the aisle doesn’t seem to be standing at mics complaining.”

Bill Eigel, a Weldon Spring Republican and a candidate for governor, said the language in the Missouri Constitution designed to prohibit noncitizen voting is similar to other states where the practice is taking place locally.&nbsp;He believes Democrats in Missouri could follow suit.“So do I think that if (St. Louis) Mayor Tishaura Jones thought that there was an opportunity to start engaging noncitizens to vote in local St. Louis city municipal elections, would she do it using the same procedure that’s happened to these other states?” he said. “I absolutely think she would. So for me, it’s important to put these additional protections in the constitution.”&nbsp;<h2>Already illegal?&nbsp;</h2>In 1865, Missouri voters approved a new constitution&nbsp;<a target="_blank" href="https://www.columbiatribune.com/story/news/2015/01/11/150-years-ago-missouri-state/21743565007/">abolishing slavery</a>. The&nbsp;<a target="_blank" href="https://scholarship.law.missouri.edu/cgi/viewcontent.cgi?article=1001&amp;context=mo_constitutions_race">1865 “Drake Constitution,”</a>&nbsp;written by what were called Radical Republicans, took the vote away from former Confederates and extended it to immigrants who were not yet citizens but who had declared their intent to become one.The provision rewarded the largest immigrant group in Missouri at the time, Germans, who were among the most anti-slavery, and therefore Radical Republican voters.&nbsp;The franchise was&nbsp;<a target="_blank" href="https://cdm16795.contentdm.oclc.org/digital/collection/p16795coll26/id/23750/rec/34">taken away from noncitizens in 1924</a>, when newcomers were more likely to come from eastern and southern Europe, in an amendment proposed by a state Constitutional Convention&nbsp;<a target="_blank" href="https://mdh.contentdm.oclc.org/digital/collection/bluebook/id/12864/rec/25">passed with 53.5%</a>&nbsp;of the vote.In addition to the century-old constitutional prohibition, state law also requires Missourians to&nbsp;<a target="_blank" href="https://law.justia.com/codes/missouri/title-ix/chapter-115/section-115-155/">declare whether they are a U.S. citizen</a>&nbsp;when registering to vote. And Missouri Secretary of State Jay Aschroft, a Republican and candidate for governor, has repeatedly clarified over the years that state law says “<a target="_blank" href="https://www.kansascity.com/news/politics-government/article242407526.html">you have to be a citizen to register to vote</a>.”Much of Missouri’s debate this year about noncitizen voting took place as part of a session-long fight over a Republican push to make it harder to amend the state constitution through the initiative petition process.&nbsp;A campaign to legalize abortion up to the point of fetal viability submitted more than 380,000 signatures to the Missouri Secretary of State’s office, paving the way for the proposed constitutional amendment to potentially land on the November ballot.In response, Republicans hoped to raise the threshold for amending the constitution from a simple majority statewide to both a majority of votes statewide and a majority of votes in five of the state’s eight congressional districts.Under that proposal, approximately 23% of voters could theoretically control the outcome, where a&nbsp;<a target="_blank" href="https://missouriindependent.com/2024/02/05/as-few-as-1-in-5-voters-could-defeat-initiative-petitions-under-missouri-senate-proposal/">vote against an amendment in four districts would be enough to defeat it statewide</a>.<figure>

 </figure>Many Republican proponents of raising the bar for amending the constitution acknowledged its chances of winning voter approval was slim.&nbsp;“Raising the threshold is a loser and various states have proven that’s a loser,” Tim Jones, state director of the Missouri Freedom Caucus,&nbsp;<a target="_blank" href="https://missouriindependent.com/2024/02/05/as-few-as-1-in-5-voters-could-defeat-initiative-petitions-under-missouri-senate-proposal/">said earlier this year</a>.&nbsp;So to bolster the amendment’s chances, Republicans added the noncitizen voting provision.&nbsp;Senate Democrats refused to allow the proposal to go to the ballot with the noncitizen language, arguing it was deceptive. They staged&nbsp;<a target="_blank" href="https://missouriindependent.com/2024/05/15/50-hour-filibuster-forces-more-negotiations-on-gop-backed-initiative-petition-changes/">a 50-hour filibuster&nbsp;</a>that ultimately killed the proposal amid Republican infighting.&nbsp;“It’s in there to deceive voters,” state Sen. Karla May, a St. Louis Democrat, said during the filibuster about the noncitizen voting ban. “It’s already law, but they want to trick voters into thinking it’s not law. It’s deceiving language added to the bill.”Gov. Mike Parson, a Republican, seemed to agree, telling a reporter from&nbsp;<a target="_blank" href="https://x.com/EmilyManleyTV/status/1790534660918743202">Nextar Media Group</a>&nbsp;that “it’s already illegal for an illegal to vote in the state of Missouri. We’ve already got that part.”With the Senate mired in gridlock, the House picked up and&nbsp;<a target="_blank" href="https://missouriindependent.com/briefs/ranked-choice-voting-missouri-ballot/">passed the rank-choice voting amendment</a>&nbsp;that included noncitizen provision. After months of heated debate over the issue, it was barely mentioned when the rank-choice voting ban was sent to the ballot on the session’s final day.“It seems like we’ve been wringing our hands for about a week or two on this particular issue,” state Rep. Brad Banderman, a St. Clair Republican, said during the House debate, “but on this day, on this Senate Joint Resolution, the other side of the aisle doesn’t seem to be standing at mics complaining.”

Already outlawed in Missouri, noncitizen voting ban will appear on statewide ballot

Drought plaguing parts of Kansas created shorter wheat plants and thinner crop stands this year. In turn, Kansas State University wheat production specialist Romulo Lollato advises growers to make adjustments at harvest time.

“This year, the biggest cause for short wheat has been drought stress,” he said. “During springtime, the crop starts to go through a phase called stem elongation. That’s when plant height is determined. In certain areas, there was virtually no moisture, which caused the plants to be short.”

Not all areas of Kansas have experienced this level of drought. Lollato said irregular rain patterns gave rise to significant plant height differences across counties and even in the same fields.

“The Kansas crop is not uniformly short. A very sparse and variable rainfall distribution created these ‘waves’ within areas where tall and short plants occur, simultaneously, in those locations,” he said.

According to Lollato, producers can attach stripper headers to the front of their combines to effectively harvest small wheat plants. Stripper headers separate the grain head from the remaining plant. On the other hand, traditional headers detach plants halfway down their stems.

Lollato said, “Essentially, they have fingers on them. Those fingers pluck the heads out from the stem. The stripper headers feed the combine with only the wheat heads, which means having a cleaner product go into the combine, with increased efficiency.”

Harvesting low-standing wheat plants with a stripper header can help improve soil quality in semi-arid areas.

“They leave more crop residue behind. It will act as a barrier against weeds and shade the fields, which cools soil temperatures and delays weed emergence. Moisture retention is another important advantage. Stripper headers reduce water loss through evaporation, runoff and erosion.”

If a producer uses a stripper header this year, future crops have the potential to benefit as well, according to Lollato.

“There is a lot of value in having more residue left in the fields,” he said. “When growers plant wheat directly into that crop residue after this year’s harvest, they get all of those benefits, like added moisture, weed control, and erosion reduction, which can help return a very good dollar amount the following summer.”

Conventional headers remain as another workable solution for operations not able to invest in additional implements.

“A stripper header is a pricey investment,” Lollato said. “However, there might be more challenges operating with a conventional header – especially on ground with a great slope – but they still work in this case.”

Making alterations to a traditional header may yield better results when harvesting stunted wheat fields with them.

“The most important thing to keep in mind is to maintain the cutting height as high as possible. You can also adjust the reel on the header to get more movement of wheat from the cutter bar to the auger,” Lollato said.

Other combine headers appropriate for harvesting poorer quality wheat stands include draper and flex heads. KSRE — Drought affected wheat fields call for supplemental equipment

DEKALB COUNTY — Two boy and a teenage girl were injured in an accident just before 5:30p.m. Monday in DeKalb County.

The Missouri State Highway Patrol reported a 2020 Polaris Ranger driven by an 8-year-old Cameron boy was northbound on SE Whitaker Road 3 miles northwest of Cameron.

The driver lost control of the UTV as he attempted a right turn. The vehicle traveled off the east side of the road, struck a fence and overturned.

Cameron EMS transported the driver and a 7-year-old male passenger from Cameron to Children's Mercy. A private vehicle transported another passenger, 18-year-old Annabelle Pall of Gallatin to Cameron Regional Medical Center.&nbsp; They were not wearing helmets, according to the MSHP.

3 injured after UTV driven by 8-year-old strikes a fence 

ATCHISON COUNTY —Law enforcement authorities are investigating a Kansas felon on new allegations.

Just before 3:30a.m. Monday police responded to a burglary alarm at the Bomgaars Retail Store, 605 South 10th Street in Atchison, according to Police Chief Mike Wilson 

When officers arrived they saw a man run from the scene into a nearby wooded area. Officers pursued the subject and located him hiding in the woods. 

It was determined that an attempted burglary into the store had occurred at the front door area of the store. Officers arrested 37-year-old Joshua A. Spurlock on requested charges of attempted burglary and criminal damage to property as well as interference with law enforcement which involved attempting to flee from the officers and giving the arresting officers a false name.&nbsp;

He has previous convictions for burglary, criminal damage and criminal trespass, according to the Kansas Department of Corrections.

Kansas felon gave officers a fake name during arrest

The Missouri Chamber of Commerce is harsh in its
assessment of this year’s legislative session, calling it dysfunctional.

State Chamber President Dan Mehan says the
General Assembly did little this year, passing only 28 non-budget bills. And
Mehan claims that when lawmakers did try to pass legislation, they too often
attempted to hamper businesses with regulations.

“This may seem like it’s odd, but this is the
truth. There was a bill that would have mandated that employers must accept gold
and/or silver as forms of payment for products or services rendered,” Mehan
tells KFEQ/St. Joseph Post in a phone interview.&nbsp; “That won’t work for God only knows how many
reasons.”

Mehan says the legislature also attempted to
revoke the long-held business right to make workplace decisions such as vaccination
policies, employee benefits, as well as diversity, equity, and inclusion
practices.

Mehan charges that instead of tackling the tough
issues facing the state, too many lawmakers attempted to pass additional business
regulations.

“You walk out of the Capitol scratching your
head, saying what are these people thinking?” Mehan states. “There’s more
important things that we can deal with such as the legal system, such as
infrastructure development, or education attainment than these petty mandates
that are just a complete pain for businesses to comply with.”

Mehan calls this session one of the least
productive, ever.

The Missouri Chamber pushed for a child care
package carried by St. Joseph state Rep. Brenda Shields that the Senate ignored
and for changes to Missouri’s statute of limitations on claims against businesses.

Mehan lays the blame at the feet of the Freedom
Caucus in the Senate, which used filibusters to tied up work in the Senate throughout the five-and-a-half month legislative session.

Despite the harsh assessment of this year’s
legislative session, the Chamber does see at least one bright spot from the
session. Mehan praises a major piece of legislation that did pass, the
anti-crime package sponsored by Sen. Tony Luetkemeyer of Parkville.

“This has stiffer penalties on it for repeat
offenders. We thought this was a good step in the right direction this year,”
Mehan says. “It was one of those rays of hope that we saw pass this year. Sen.
Luetkemeyer deserves a lot of credit for getting that done in a very difficult
year in the Missouri Senate.”

Other wins during the session, according to the
Missouri Chamber, were the expansion of the MOBUCKS low-interest loan program
and the appropriation of $727.5 million to expand I-44 to six lanes in
Springfield, Joplin, and Rolla.

MO Chamber of Commerce calls legislative session dysfunctional

KESJ
of St. Joseph, better known as Joe Town 107.5, won Station of the Year at the
Missouri Broadcasters Association awards ceremony held this past weekend at the
Margaritaville Lake Resort in Osage Beach.

Joe
Town won in the medium market radio category for its community involvement and
charitable campaigns. Program Director Gregg Lynn accepted the award on behalf
of the station during the ceremony. Lynn also won second place for his work on
KESJ in the category of Social Media Star.

Station
of the Year was one of several awards received by Eagle St. Joseph radio
stations as well as St. Joseph Post by the MBA. KFEQ won Best Use of Digital
Media, medium market radio, for its Chiefs’ Training Camp coverage. KFEQ swept
the Feature Reporting category for medium market radio. Sports Director Tommy
Rezac won first place for his feature on Special Olympics athlete Charlie
Phillips of Savannah. News Director Brent Martin won second place for his
feature on efforts to pass Max’s Law.
